BILL NO. 73 -91 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE 1ST <br />EAST -WEST ALLEY NORTH OF CEDAR STREET, RUNNING EAST FROM ST. <br />PETER STREET, FOR A DISTANCE OF APPROXIMATELY 345 FEET TO NOTRE <br />DAME AVENUE, ALL IN CHAPOTON PLACE SUBDIVISION OF COTTRELL'S <br />ADDITION TO LOWELL, AND ST. PETER STREET, FROM MINER STREET <br />RUNNING, SOUTH TO CEDAR STREET, FOR A DISTANCE OF APPROXIMATELY <br />322 FEET. <br />This being the time heretofore set for public hearing on the above bills, proponents <br />and opponents were given an opportunity to be heard. John Ford, attorney for the <br />petitioner St. Joseph Medical Center, made the presentation for the bill. He <br />indicated this vacation was necessary in order to build a new medical pavilion. <br />Council Member Niezgodski made a motion to recommend this bill to the Council <br />favorable, seconded by Council Member Zakrzewski. The motion carried. <br />BILL NO. 9 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING CHAPTER 4, ARTICLE 4, SECTION 4 -60 OF THE MUNICIPAL CODE <br />OF THE CITY OF SOUTH BEND COMMONLY KNOWN AS "TRANSIENT <br />MERCHANTS ". <br />This being the time heretofore set for public hearing on the above bills, proponents <br />and opponents were given an opportunity to be heard. Council Member Slavinskas made <br />the presentation for the bill. He indicated this bill would amend the code for <br />transient merchants selling Christmas trees during the months of November and <br />December. Council Member Zakrzewski made a motion to amend the bill by changing <br />Section 4 to read as follows: Thirty dollars ($30.00) for proposed business <br />operations during the months of November and /or December, which only sell live <br />and /or natural Christmas trees and /or live and /or natural wreaths., seconded by <br />Council Member Coleman. The motion carried Council Member Luecke made a motion to <br />recommend this bill to the Council favorable, as amended, seconded by Council Member <br />Coleman. The motion carried. <br />BILL NO. 21 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING CHAPTER 6 OF THE MUNICIPAL CODE BY THE INCLUSION OF NEW <br />ARTICLE 11 ENTITLED BUILDING CONTRACTOR LICENSING REQUIREMENTS. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Duda made the <br />presentation for the bill. Council Member Luecke made a motion to accept the <br />substitute bill and amend it in Section III by changing the implementation date to <br />July 1, 1992, seconded by Council Member Zakrzewski. The motion carried. Council <br />Member Duda indicated this bill would require written proof of Workers' Comp <br />coverage, and establish a non - reverting fund to help defray the cost of the <br />program. Mark Donaho, 23555 Brick Rd, president of the St. Joseph Trades Council, <br />spoke in favor of the bill. Robert Urbanski, 3343 Hedge Maple, member of the task <br />force, asked for support of this bill; Don Blemis, 63529 Poppy Rd.; Craig Fry, 637 <br />Bayview, Richard Nussbaum, City Attorney, spoke in favor of the bill. Council <br />Member Luecke made a motion to recommend this bill to the Council favorable, <br />seconded by Council Member Zakrzewski. The motion carried. <br />Council Member Puzzello made a motion to combine public hearing on the next two <br />bills, seconded by Council Member Niezgodski. The motion carried. <br />BILL NO. 74 -91 <br />A BILL TRANSFERRING MONIES FROM VARIOUS ACCOUNTS TO VARIOUS <br />ACCOUNTS WITHIN THE VARIOUS FUNDS OF THE CITY OF SOUTH BEND, <br />INDIANA FOR THE YEAR 1991. <br />BILL NO. 75 -91 A BILL INCREASING APPROPRIATIONS AND DECREASING APPROPRIATIONS <br />WITHIN THE VARIOUS DEPARTMENTS WITHIN THE VARIOUS FUNDS OF THE <br />CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1991. <br />._ This being the time heretofore set for public hearing the on above bills, proponents <br />and opponents were given an opportunity to be heard. Council Member Puzzello <br />reported that the Personnel and Finance Committee had met on these bills and <br />recommended them to the Council favorable, as amended. Council Member Puzzello made <br />a motion to accept the substitute bills on file with the City Clerk, seconded by <br />Council Member Niezgodski. The motion carried. Jeff Renard, City Auditor, made the <br />presentation for the bills. He indicted that these bills were the annual transfer <br />and appropriation bills passed by the Council each year. Council Member Luecke made <br />a motion to recommend Bill No. 74 -91 to the Council favorable, as amended, seconded <br />by Council Member Coleman. The motion carried. Council Member Luecke made a motion <br />recommend Bill No. 75 -91 to the Council favorable, as amended, seconded by Council <br />Member Puzzello. The motion carried. <br />BILL NO. 76 -91 A BILL APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING THE <br />EXPENSES OF THE DESIGNATED ENTERPRISE FUNDS OF THE CITY OF SOUTH <br />BEND, INDIANA, FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1992, AND <br />ENDING DECEMBER 31, 1992, INCLUDING ALL OUTSTANDING CLAIMS AND <br />OBLIGATIONS, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Puzzello <br />reported that the Personnel & Finance Committee and the Utilities Committee had met <br />on this bill and recommended it to the Council favorable.
