<br />A public hearing was held on the resolution at this time. Council Member Ladewski
<br />read the resolution. Dr. Strzelecki, President of the Board of Trustees, spoke
<br />regarding the Clinic, and thanked the Council for the resolution. Council Member
<br />Duda made a motion to adopt the resolution, seconded by Council Member Coleman. The
<br />resolution was adopted by a roll call vote of nine ayes.
<br />Council Member Zakrzewski made a motion to resolve into the Committee of the Whole,
<br />seconded by Council Member Coleman. The motion carried

<br />BILL NO. 58 -91 A BILL AMENDING THE
<br />SOUTHEAST CORNER OF
<br />CITY OF SOUTH BEND,
<br />it of the City of South Bend met in the
<br />1991 at 7:18 p.m., with nine members
<br />ZONING ORDINANCE FOR PROPERTY LOCATED AT THE
<br />HOWARD STREET AND ST. PETER STREET IN THE
<br />INDIANA.
<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Council Member Slavinskas
<br />reported that the Zoning and Vacation Committee had met on this bill and had no
<br />recommendation for the Council. John Byorni, Area Plan, gave the staff report,
<br />which was unfavorable. Tim: Hartzer, attorney, made the presentation for the bill.
<br />He indicated this was a mixed neighborhood, and would benefit from new development,
<br />such as this bookstore. He indicated this was not spot zoning in the traditional
<br />sense, since there is a bookstore at this location. He indicted this new structure
<br />will improve the appearance of the site. Richard Nussbaum, City Attorney, spoke in
<br />favor of this rezoning. He indicated the City had issued a building permit for a
<br />library at the corner of Howard and Notre Dame, which was later withdrawn. He
<br />indicated the Board of Zoning appeals hade made a finding that a there could be a
<br />library in "A" residential as long as it was operated by a not for profit
<br />corporation. He indicated the owners of Pandora's planned to form such a
<br />corporation, so this zoning was a compromise. Thomas Gideon, 920 N. Notre Dame;
<br />Arthur Quigley, 1019 N. Frances; Jane Gurthet, 907 N. Notre Dame; Marguerite Taylor,
<br />714 E. Corby; Ellen Martin, 1007 Howard; spoke against this zoning. Arlene Quigley,
<br />1019 N. Francis, presented a petition with 303 signatures. Council Member Soderberg
<br />made a motion to recommend this to the Council unfavorable, seconded by Council
<br />Member Slavinskas. The motion failed on a roll call vote of four ayes (Council
<br />Members Soderberg, Slavinskas, Zakrzewski and Ladewski) and five nays. Council
<br />Member Puzzello made a motion to amend the bill as follows; after the word Area add
<br />" and subject to a final site development plan and appropriate variance(s) and
<br />exceptions regarding parking requirements from the Board of Zoning Appeals ",
<br />seconded by Council Member Luecke. The motion carried. Council Member Niezgodski
<br />made a motion to recommend this bill to the Council favorable, as amended, seconded
<br />by Council Member Puzzello. The motion carried on a roll call vote of five ayes and
<br />four nays (Council Members Soderberg, Slavinskas, Zakrzewski and Ladewski.)
<br />Council Member Soderberg made a motion to recess, seconded by Council Member
<br />Slavinskas. The motion carried and the meeting was recessed at 9:01 p.m., and
<br />reconvened at 9:10 p.m.
<br />LL NO. 62 -91 A BILL AMENDING THE ZONING ORDINANCE AND ESTABLISHING A HISTORIC
<br />LANDMARK FOR PROPERTY LOCATED AT 302- S. MAIN STREET IN THE CITY
<br />OF SOUTH BEND, INDIANA.
<br />Council Member Slavinskas reported that the Zoning and Vacation Committee had met on
<br />this bill and recommended it unfavorable to the Council. Council Member Luecke made
<br />a motion to continue public hearing on the bill until the second meeting in
<br />February, seconded by Council Member Zakrzewski. The motion carried.
<br />BILL NO. 67 -91 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA,
<br />VACATING THE FIRST NORTH -SOUTH ALLEY EAST OF MAIN STREET, RUNNING
<br />NORTH FROM COLFAX AVENUE FOR A DISTANCE OF APPROXIMATELY ONE
<br />HUNDRED NINETY -EIGHT FEET (198') TO THE SOUTHERN BOUNDARY OF THE
<br />FIRST EAST -WEST ALLEY SOUTH OF LASALLE STREET BETWEEN MICHIGAN
<br />AND MAIN STREETS, ALL IN THE CITY OF SOUTH BEND, INDIANA.
<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Jenny Manier, Assistant City
<br />Attorney, made the presentation for the bill. She indicated this vacation was
<br />necessary in order for the South Bend Tribune to build their addition on the site of
<br />the former Colfax Theatre. Council Member Slavinskas made a motion to accept the
<br />substitute bill on file with the City Clerk, seconded by Council Member Luecke. The
<br />motion carried. David Ray, a representative of the South Bend Tribune, spoke in
<br />favor of this vacation. Council Member Luecke made a motion to recommend this bill
<br />to the Council favorable, seconded by Council Member Slavinskas. The motion
<br />carried.
