Customer agrees to pay all costs <br />incurred in connection with additional work done at the Real Estate beyond the scope of the Work. <br />10. Customer, at Customer’s sole expense, shall pay for all of Company’s use of electric and water utilities at the Real <br />Estate. <br />11. Unless otherwise expressly provided by this Contract, Customer shall allow Company’s owners, representatives, <br />employees, independent contractors, to use Customer’s restroom on the Real Estate during the duration of the <br />Work. <br />12. Company estimates on concrete removal is based on the assumption that the existing concrete is free of <br />reinforcement and not greater than four inches (4”) thick. In the even concrete at the Real Estate is reinforced or <br />thicker than 4”, Customer shall pay additional amounts charged by Company in connection with the reinforced <br />or thick concrete. <br />13. Customer acknowledges cracking, scaling and discoloration and similar imperfections in concrete my occur <br />despite Company’s skill of workmanship and quality of materials and agrees not to make any claim against <br />Company based on of any such imperfections. <br />14. In the event the Plans and Specifications indicate Company will use Customer’s new or existing equipment or <br />materials, Customer shall be solely liable for all such materials and equipment. In the event Customer performs <br />any work on the Real Estate at the same time or related to the Work performed by the Company, Customer shall <br />be solely liable for all work performed by Customer and shall have no claim against Company related to such <br />work. <br />15. In the event Customer provides materials for the Work, Customer, at Customer’s sole expense, shall provide the <br />specifications for all such material to Company prior to the beginning of the Work and shall provide all such <br />materials to Company at the Real Estate prior to the beginning of the phase of the Work in which said materials <br />will be used. In the event Customer requests Company use any material in the Work from any material provider <br />other than the Company’s customary suppliers, Customer agrees to pay a ten percent (10%) markup on the <br />vendor’s price as a contractor’s fee to the Company. <br />16. Invoices and receipts for materials are not available to the Customer for review. <br />17. Company shall remove all trash and debris created by Company related to the Work at the Real Estate when, in <br />its sole discretion, a full load of trash has accumulated or when Work has been completed. Company shall not be <br />liable for Customer's trash removal. <br />18. Any changes to the Contract or these specifications due to any governmental codes and/or regulations may <br />result in additional cost to Customer. <br />19. Any price allowances or price ranges are estimated prices and the actual prices may vary up or down depending <br />on the amount of work performed. <br />20. All material price quotes are good for __ days.  Any increase in material cost after that date will be added to the <br />total cost of the Work. <br />21. In the event Customer and Company agree to a Change Order of the Work, all Change Orders shall be subject to <br />a ten percent (10%) charge in addition to the contractor fee and cost of the work and/or materials included in <br />the Change Order. Such Change Orders include, but are not limited to, changes after the Work has been <br />completed and additions or changes during mechanicals walk-through. <br />22. Customer shall make all selections of materials within the timeline agreed to by Company and Customer. <br />Customer shall be solely liable for all delays in scheduling and completion of the Work, as well as any additional <br />costs related thereto, caused by delays in Customer selection of materials after the agreed time perio
