23. Customer shall approve any draw request presented by                                        that have met                           ‘s <br />criteria for approval, including the final draw. Any retainage for “punch list items” shall not exceed the actual cost <br />of completing said “punch list items.” <br />24. These Plans and Specifications and any additional specifications encompass all the Work done under the <br />Contract. If blueprints have been provided to Company, they shall only be considered a guide for the Work, and <br />in no way add to the Work contracted. Customer shall review the Plans and Specifications prior to agreeing to <br />the Contract and any work not included in the Plans and Specifications shall not be completed by the Company <br />unless Customer pays additional amounts to the Company for said work. <br />25. The customer acknowledges Company may, at their sole option, mark up all materials and Subcontractor cost by <br />a 15 % overhead. <br />26. The Company may contract with any subcontractor with regard to the Work. <br />27. Any Customer who signs the Contract may sign a Change Order. If such a Change Order is signed by any <br />Customer and the Company, the Change Order shall be binding on all Customers. <br />28. Any Customer who signs the Contract may approve selections. If any customer approves a selection, this <br />selection and the associated cost shall be binding on all Customers. <br />29. Either Customer or Company may, at their sole option, terminate the Contract for any reason or no reason <br />effective upon delivery of written notice to the other party. <br />30. In the event of the termination of the Contract prior to the completion of all of the Work, Company shall be <br />entitled to retain all amounts earned for Work performed and materials ordered pursuant to this Contract. <br />31. Customer agrees not to bring any items into the worksite or have any items , such as appliances, furniture, ect., <br />delivered to the worksite before completion of the work and the approval of the Company. Or until Company is <br />ready to install.  <br />32. Customer acknowledges Drywall is finished with a regular float for flat paint. Additional charges, to upgrade to a <br />full float finish, will be needed if a sheen paint is desired by the Customer. Customer agrees not to make any <br />claim against the company for these conditions. <br />33. The Customer acknowledges that ceramic tile labor costs are estimated by using 12x24 tiles on floors and shower walls <br />(with one niche included) and 3x6 subway tiles for back splashes. Any accent stripes, natural stone tiles or special patterns <br />will result in an increase in the cost of labor. This amount will be determined once materials and patterns are selected. <br />34. The Company reserves the right to use photos taken, before and after, that may be published on Barbour Construction <br />Website, Houz, etc. All identification i.e., location, Customer’s name and any personal information or items will be <br />eliminated from these photos before publishing. <br />35. Customer acknowledges that electrical devises are estimated as “standard” unless noted otherwise this does not include <br />USB’s, GFI’S, Dimmers, Decora or colors other than the standard white, Ivory and light almond. These options are <br />available at an additional cost. <br />
