Specifications

<br />1. Company shall not be held liable for costs to remedy existing code defects unless specifically included in the
<br />Plans and Specifications. Repair of all pest and/or rot damage shall not be included in the Contract. All
<br />extermination of termites and/or other pests shall be paid solely by the Customer.
<br />2. Customer gives Company permission to drive vehicles on and/or across the driveway of the Real Estate and to
<br />use such areas for any purposes as are reasonably necessary for the Company to complete Work.
<br />3. Unless otherwise expressly provided in this Contract, Customer shall remove all landscaping, trees, stones,
<br />fences, etc. as necessary prior to the commencement of the Work. Company shall not be liable for any damage
<br />to landscaping, yard work, grass, etc. Company shall not be liable for damage to any item below ground surface.
<br />In the event Company encounters abnormal soil conditions below ground surface, Customer agrees to pay all
<br />additional costs related to the abnormal soil conditions. Customer acknowledges and accepts that some
<br />landscaping, fencing, etc. may be necessary after completion of the Work. Customer, at Customer’s sole expense,
<br />shall be responsible for all field systems, gutter drainage, etc. on the Real Estate.
<br />4. Customer shall be responsible for all work related to any irrigation and/or sprinkler system on the Real Estate,
<br />including, but not limited to, marking and relocating all lines, valves, heads, controls, etc.
<br />5. Customer, at Customer’s sole expense, shall relocate all utilities, including but not limited to, electric, natural gas,
<br />and water as necessary for the completion of the Work.
<br />6. Customer, at Customer’s sole expense, shall mark all septic systems on the Real Estate. Customer, at Customer’s
<br />sole expense, shall be responsible for all septic and/or well system requirements. Customer and/or Customer's
<br />engineer shall submit all necessary drawings, soil tests and other information necessary for any septic and/or
<br />well permits. Company makes no allowances for any tests, prints etc. nor any septic and/or well changes in the
<br />Plans and Specifications or Payment Schedule.
<br />7. Customer, at Customer’s sole expense, shall relocate, cover or otherwise protect personal property on the Real
<br />Estate. If any such items are not removed by Customer, Company shall not be held liable for any loss or damage
<br />to said items, except to the extent said loss or damage is caused by Company’s gross negligence or reckless
<br />misconduct.
<br />8. If it is necessary to relocate any mechanicals, plumbing, electric, heating, and weight bearing supports hidden in
<br />walls, ceilings and/or floors, Customer to pay all additional costs related to the relocation.
<br />9. All plumbing fixtures, ceramics, woods, colors, patterns, materials, designs, and textures of samples may not
<br />match the materials already at the Real Estate and can vary from samples. Company shall use its best efforts to
<br />match existing materials at the Real Estate but makes no guarantee or warranty with regards to the Work

<br />General Conditions 1. Portable Sanitation Unit
<br />* Provide an onsite sanitation unit for all trade partners, venders and BC crew
<br />members.
<br />2. Dumpster/Trash
<br />* Provide an onsite dumpster or dump trailer for all demo and building debris.
