Soils and Water Table Review Requirement Ordinance <br />Page 2 <br />• "Published Soil Surveys for Indiana — Updates" maintained and updated by the U.S. <br />Department of Agriculture's Natural Resources Conservation Service which <br />specifically provides data on St. Joseph County, Indiana <br />• USGS Groundwater Publications available at hqp : / /water.usgs.gov /ogw/pubs.html <br />The Common Council recognizes the qualifications, duties, responsibilities of the <br />Building Commissioner set forth in Section 6 -4.4 of the South Bend Municipal Code. The <br />training and expertise of this key position and the Building Commissioner's ability to issue or <br />deny permits after a detailed review to determine compliance with and enforcement of the <br />building regulations codified in Chapter 6 of the South Bend Municipal Code is critical. The <br />proposed regulations addressing soils and water table review would improve the permit review <br />process. It further authorizes the Building Commissioner to work in conjunction with the <br />Director of Public Works and other agencies when conducting soils and water table reviews. <br />This ordinance has been prepared in the interest of providing another essential tool for the <br />Building Department. It provides the necessary enabling legislation so that regular, systematic <br />and routine reviews of soils and water tables are made prior to a permit being issued to build or <br />construct any new dwelling used primarily for residential purposes within the City of South <br />Bend, Indiana. <br />This ordinance is believed to be in the best interests of the citizens of the City of South <br />Bend, Indiana. <br />91a, 314;r <br />6m, & & &rda&mQ(by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />Section I. Chapter 6 of the South Bend Municipal Code is amended by the inclusion of new <br />Section 6 -6.6 in Article 2 which shall read in its entirety as follows: <br />Sec. 6 -6.6 Soils & Water Table Review Required as Part of the Permit Process for New <br />Dwelline(s). <br />(a) Before a permit to build or construct any new dwelline building or- s;tndetidfe a <br />epAarsc or meve an existing stru ~° within the City, a soils and water table review of the <br />immediate land proposed for such dwelline building, eenstrueti : f efgafg °meat v- - rel v <br />p[civi—cv <br />the subjeetpreperty, must be made by the Building Commissioner. For pMoses of this Section, <br />the dwelling shall mean any building, or portion of a building, which is designed or used <br />primarily for residential purposes, including a single family dwelling two family dwelling and <br />multifamily dwelling but not including hotels motels boarding houses lodging houses and bed <br />& breakfast.) <br />' The definition for "dwelling" is identical to the one codified in the zoning regulations of the South Bend Municipal <br />Code Section 21 -11.02 <br />
