GMP EXHIBIT 5 Assumptions and Clarifications The following assumptions and clarifications apply to the Scope of Work included in the Guaranteed Maximum Price. The Scope of Work included in the Guaranteed Maximum Price is that described in the specifications (GMP Exhibit 2), drawings (GMP Exhibit 3), and allowances (GMP Exhibit 4), subject to the assumptions and clarifications noted below. 2. No testing for, or demolition and removal of, Hazardous Materials is included, regardless of notes regarding or allusions to the presence of Hazardous Materials in the Contract Documents. A Hazardous Material is any substance or material identified now or in the future as hazardous under any federal, state or local law or regulation, or any other substance or material including mold, fungi, or bacteria which may be considered hazardous or otherwise subject to statutory or regulatory requirement governing handling, disposal or clean-up. The Construction Manager shall not be obligated to commence or continue work until any Hazardous Material discovered at the project Worksite has been removed, rendered or determined to be harmless by the Owner as certified by an independent testing laboratory and approved by the appropriate government agency. 3. Costs or fees assessed by utility companies related to the project or required to complete the work are not included in the Guaranteed Maximum Price. These costs or fees include, but are not limited to, tap fees, impact fees, line installation charges, meter charges, inspection fees, connection charges, etc. 4. Neither removal nor re -installation of existing furnishings and equipment are included in the Guaranteed Maximum Price. These existing furnishings and equipment include, but are not limited to, signage and artwork, banners, food and souvenir vendor carts, inflatable play structures, storage shelves and cribs, tables, desks, chairs, projectors, televisions, computers, phones, and other technology devices. 5. Commissioning of systems is not included in the Guaranteed Maximum Price. Start-up requirements noted in the specifications are included. 6. The only signage included in the Guaranteed Maximum Price is that included in the allowance for signage noted in GMP Exhibit 4. This allowance is for the signage work noted on the plans. New signage, or reinstallation of existing signage that was connected to demolished structure, on the concourse level in Areas A, B, C, and D is not noted on the plans. Graphic printed films on portions of the work are not included in the Guaranteed Maximum Price. These films included, but are not limited to, those noted at the elevators or glass surfaces. These films are assumed to be provided by the City of South Bend or the South Bend Cubs. 8. New finishes are included only as shown on the finish schedule on sheets 1-A600 and 3-A600. Rooms where other work occurs, but which are not noted to receive new finishes on sheet 1-A600 or 3-A600, will not receive new finishes. GMP Exhibit 5 Page 36/39
