<br />CITY OF SOUTH BEND <br />STUDEBAKER NATIONAL MUSEUM <br />SKYLIGHT REPLACEMENT SUBSTITUTION PROCEDURES 01250-3 <br />b. Substitution Requests Made After Award of Contract: <br />1) Consideration: Substitution will only be considered if submitted by the <br />Contractor and substitution request is being made because a specified <br />product has become unavailable. <br />2) Request shall include information listed under “Consideration <br />Requirements” Article specified below. <br /> <br />6. Supporting Information for Substitutions: <br /> <br />a. Include the following supporting information: <br />1) Name of Product: Name of material or equipment for which substitution is <br />being requested and a complete description of the proposed substitute <br />including drawings, product data, performance and test data, and any <br />other information necessary for an evaluation. <br /> <br />2) Architect Notification: The Architect must be notified of changes in other <br />materials, equipment or other Work that incorporation of this substitute <br />would require. <br />a) Alterations or changes to other Work are the responsibility of the <br />Contractor proposing substitution, including redesign if <br />determined by Architect. <br /> <br />b. Burden of proof of the merit of the proposed substitute is upon the proposer. <br /> <br />c. It is understood and agreed Contractors, material suppliers, and their <br />subcontractors that quotes and contracts shall be based on products (material and <br />equipment) and processes as specified or as revised by addenda or modification. <br /> <br />7. Consideration Requirements: <br /> <br />a. Substitution request will be considered by Architect when the following conditions <br />are satisfied: <br />1) Extensive revisions to Contract Documents are not required. <br />2) Proposed changes are in keeping with the general intent of Contract <br />Documents. <br />3) Request is timely, fully documented, and properly submitted. <br />4) Additionally, 1 or more of the following are satisfied: <br />a) If a specified product is not available. <br />b) Specified product or method of construction cannot be provided <br />within Contract Time. Request will not be considered if product or <br />method cannot be provided as a result of failure to pursue the <br />Work promptly or coordinate activities properly. <br />c) Specified product or method of construction cannot receive <br />necessary approval by a governing authority, and requested <br />substitution can be approved. <br />d) Substantial advantage is offered to Owner, in terms of cost, time, <br />energy conservation of other considerations of merit, after <br />deducting offsetting responsibilities the Owner may be required to <br />bear as determined by Architect, which includes additional <br />compensation to Architect for redesign and evaluation services, <br />increased cost of other construction, or separate contractors, and <br />similar considerations.
