All rights reserved. <br />This is EXHIBIT K, consisting of 9 pages, referred to in <br />and part of the Agreement between Owner and Engineer <br />for Professional Services dated September 28, 2021. <br />AMENDMENT TO OWNER-ENGINEER AGREEMENT <br />Amendment No. 2 <br />1.Background Data: <br />a.Effective Date of Owner-Engineer Agreement:September 28, 2021 <br />b.Owner:Board of Public Works, City of South Bend, Indiana <br />c.Engineer:Donohue & Associates, Inc. <br />d.Project:New Fellows Booster Pumping Station <br />2.Description of Modifications: <br />a.Engineer shall perform or furnish the following Additional Services: <br />1.Construction Phase Services for Fellows Booster Station Contract A – Station <br />Procurement and Contract B – Station Installation and Site Work. <br />2.General Administration of Construction Contract. Consult with Owner and act as <br />Owner’s representative as provided in the General Conditions of the Contract <br />Documents included in the Project Manual. The extent and limitations of the <br />duties, responsibilities and authority of the Engineer as assigned in said General <br />Conditions shall not be modified, except as Engineer and Owner may otherwise <br />agree in writing. All of Owner’s instructions to the construction contractor will <br />be issued through Engineer, who shall have authority to act on behalf of Owner in <br />dealings with construction contractor to the extent provided in this Agreement and <br />said General Conditions except as otherwise provided in writing. <br />3.Contract Documents Distribution. Engineer shall compile for and deliver to the <br />Owner and Contractor conformed for construction documents including relevant <br />portions of addenda. The conformed construction documents are issued for <br />convenience only. Furnish to Contractor up to four (4) printed copies of the <br />Project Manual and half-scale or full-scale Drawings plus one copy of the Project <br />Manual and Drawings in electronic portable document format (PDF) that <br />incorporate all issued addenda during the bid phase. Additional printed copies will <br />be furnished to the Contractor upon request at the cost of reproduction. If <br />requested by the Contractor, one set of drawings in AutoCAD electronic format <br />will be provided to the Contractor. Electronic files will be delivered upon receipt
