Retention of records will be for a period of five year, two years, one year, <br />indefinite period based upon the Federal Motor Carrier Regulations, Subpart <br />D - Handling of Test Results, Record of Retention and Confidentially <br />'382.401 Retention of records. <br />Specific types of records shall be maintained as detailed in the Federal Motor <br />Carriers Regulations. The type or records may include: records related to the <br />collection process, records related to the driver's test results, records related <br />to other violations of part '382, records related to evaluations, records <br />related to education and training, administrative records related to alcohol <br />and controlled substances testing. <br />All records will be maintained as required and shall be made available for <br />inspection at Visu-Sewer, lnc., W230 N4855 Betker Road, Pewaukee, Wl <br />53072; Visu-Sewer, lnc., 3155 104th Lane NE, Blaine, MN 55449 orVisu- <br />Sewer, lnc., 1065 15th Street SW, Mason City, lA 50401 within 2 business <br />days after request has been made by an authorized representative of the <br />Federal Highway Administration. <br />Visu-Sewer will also permit access to all facilities utilized in complying with <br />the requirements of 49 CFR Part 382 to the Secretary of Transportation, any <br />DOT agency, or any State or local officials with regulatory authority over the <br />employer or any of its drivers. Visu-Sewer will also make available copies of <br />all results for employer alcohol and/or controlled substances testing <br />conducted under this Policy and any other information pertaining to the <br />employer's alcohol misuse and/or controlled substances use prevention <br />program, when requested by the Secretary of Transportation, any DOT <br />agency, or any State or local officials with regulatory authority over the <br />employer or any of its drivers. When requested by the National <br />Transportation Safety Board as part of an accident investigation, Visu-Sewer <br />will disclose information related to the employer's administration of a post- <br />accident alcohol and/or controlled substance test administered following the <br />accident under investigation. <br />Visu-Sewer may disclose information required to be maintained under this <br />part pertaining to a driver, the decision-maker in a lawsuit, grievance, or other <br />proceeding initiated by or on behalf of the individual, and arising from the <br />results of an alcohol and/or controlled substance test administered under this <br />part, or from the employer's determination that the driver engaged in conduct <br />prohibited by subpart B of this part (including, but not limited to, a worker's <br />compensation, unemployment compensation, or other proceeding relating to <br />a benefit sought by the driver.) <br />Records will also be made available to an identified person or a subsequent <br />employer upon receipt of a written request from a driver, but only as <br />expressly authorized and directed by the terms of the driver's written consent. <br />43
