a <br />controlled substances testing program under Part 382, the information <br />delineated above. <br />Notification of Test Results <br />Any prospective employee requesting the results of a pre-employment <br />drug test will be provided with those results within sixty (60) days of <br />being notified of the disposition of his/her job application. <br />a <br />Visu-Sewer will notify any driver who tests positive in a pre-duty, <br />random, post-accident or reasonable suspicion drug test of those <br />results, along with the identity of the controlled substance(s) verified as <br />positive. <br />ln the event visu-sewer receives notification of a positive test resurt <br />while any driver is in service, Visu-sewer will make reasonable efforts <br />to remove the driver from service, wherever the driver may be located. <br />ln the event a driver is removed from service due to a positive test <br />result, the driver will be required to arrange for transportation home, at <br />his own expense. <br />Confidentiality and Recordkeeping <br />Visu-Sewer will maintain all records generated under this Policy in a secure <br />manner so that disclosure to unauthorized persons does not occur. As a <br />result, the results of any tests administered under this Policy and/or any other <br />information generated pursuant to this Policy will not be disclosed or released <br />to anyone without the express written consent of the employee, except where <br />otheruvise required or authorized by law. ln addition, visu-Sewer's contract <br />with its designated laboratory requires it to maintain all employee test records <br />in confidence. <br />However, the laboratory or Visu-Sewer may disclose information required to <br />be maintained under this Policy pertaining to a driver, the employer or the <br />decision-maker in a lawsuit, grievance, or other proceeding initiated by or on <br />behalf of the individual, and arising from the results of an alcohol and/or <br />controlled substance test administered under this Policy, or from the <br />employer's determination that the driver engaged in conduct prohibited by this <br />Policy (including, but not limited to, a worker's compensation, unemproyment <br />compensation, or other proceeding relating to a benefit sought by the driver.) <br />Upon written request by any driver, Visu-sewer will prompfly provide copies <br />of any records pertaining to the driver's use of alcohol or controlled <br />substances, including any records pertaining to his or her alcohol or <br />controlled substances tests. Access to a driver's records will not be <br />contingent upon payment for records other than those specifically requested. <br />Records will be maintained in a secure location with controlled access. <br />42
