he shall contact company officials, who will take appropriate action <br />and/or refer the employee to the employer's employee assistance or <br />rehabilitation program. <br />lf the MRO determines that there is a legitimate medical explanation <br />for the positive test result, he/she will report the results to the employer <br />as negative. He/she will also report as negative any test result that is <br />not supported by sufficient quality control, inspection reports or other <br />scientific data. <br />The MRO may report to the employer using any communications <br />device, but in all instances will foruvard a signed, written notification <br />within three business days of completion of the process. This written <br />report will contain the following information: <br />That the controlled substances test being reported was in <br />accordance with 49 CFR Part 40; <br />The name of the individual for whom the test results are being <br />reported; <br />The type of test indicated on the custody and control form (i.e. <br />random, post-accident, etc.); <br />The date and location of the test collection; <br />The identities of the persons or entities performing the <br />collection, analysis of the specimens and serving as the medical <br />review officer for the specific test; <br />The verified positive results of a controlled substances test, <br />either positive or negative, and if positive, the identity of the <br />controlled substance(s) for which the test was verified positive. <br />The MRO will maintain all dated records and notifications, identified by <br />individual, for a minimum of five years for verified positive controlled <br />substances test results and a minimum of one year for negative and <br />canceled controlled substances test results. <br />No person may obtain the individual controlled substances test results <br />retained by an MRO nor may the MRO release the individual controlled <br />substances test results of any driver to any person, without first <br />obtaining a specific, written authorization from the tested driver. <br />However, an MRO will not be prohibited from releasing, to the <br />employer or to officials of the Secretary of Transportation, any DOT <br />agency, or any State or local officials with regulatory authority over the <br />a <br />a <br />a <br />o <br />a <br />a <br />4I
