The MRO will also report the result to the <br />employer and inform the employer that another collection under <br />direct observation will be required. lf there is an acceptable <br />explanation for the "unsuitability," the MRO will report the <br />specimen as cancelled. <br />Specimen adultered - The MRO will report the result as <br />"specimen adulterated" to Visu-Sewer and inform Visu-Sewer <br />that the laboratory finding constitutes a "refusal to test" under <br />this Policy. <br />Disclosure of lnformation To Third Parties <br />The MRO will not reveal individual test results to anyone unless he or <br />she has been presented with a written authorization from the tested <br />employee. The MRO, may, however, reveal to Visu-Sewer, without an <br />authorization, relevant employee qualification information which <br />indicates whether the employee has tested positive for a controlled <br />substance. <br />Except as provided below, the MRO will not disclose to any third party <br />medical information provided by the individual to him/her as a part of <br />the testing verification process. However, the MRO may disclose such <br />information to the employer, Federal agency or a physician <br />responsible for determining the medical qualification of the employee <br />under an applicable DOT regulation, as applicable, only if - <br />An applicable DOT regulation permits or requires such <br />disclosure; <br />ln the MRO's reasonable medicaljudgment, the information <br />could result in the employee being determined to be medically <br />unqualified under a DOT rule; or <br />ln the MRO's reasonable medicaljudgment, in a situation in which <br />there is no DOT rule establishing physical qualification standards <br />applicable to the employee, the information indicates that continued <br />performance by the employee of his or her safety-sensitive function <br />could pose a significant safety risk. <br />Before obtaining medical information from the employee as part of the <br />verification process, the MRO will advise the employee that the <br />information may be disclosed to third parties as provided above and of <br />the identity of any parties to whom the information may be disclosed. <br />lf the MRO, after completing his review, verifies a positive test result, <br />40 <br />a
