test that he/she has 72 hours in which to request a test of the split <br />specimen. lf the employee requests an analysis of the split specimen <br />within 72 hours of such notice, the MRO will direct, in writing, the <br />laboratory to provide the split specimen to another DHHS-certified <br />laboratory for analysis. The employee will not be allowed to request a <br />reanalysis of the primary specimen and any retest requested by the <br />employee will be at the employee's expense. <br />lf the analysis of the split specimen fails to reconfirm the presence of <br />the drug(s) or drug metabolite(s) found in the primary specimen, or if <br />the split specimen is unavailable, inadequate for testing, or untestable, <br />the MRO will cancel the test and report the cancellation and the <br />reasons for it to the DOT, the employer and the employee. However, <br />because some analytes deteriorate or are lost during freezing andior <br />storage, quantitation for a retest is not subject to a specific cutoff <br />requirement, but must provide data sufficient to confirm the presence <br />of the drug or metabolite. <br />lf an employee has not contacted the MRO within 72 hours, the <br />employee may present the MRO with information documenting that <br />serious illness, injury, inability to contact the MRO, lack of actual notice <br />of the verified positive test, or other circumstances unavoidably <br />prevented the employee from timely contacting the MRO. lf the MRO <br />concludes that there is a legitimate explanation for the employee's <br />failure to contact'him/her within 72 hours, the MRO will direct that <br />analysis of the split specimen be performed. <br />ln the event the MRO receives a laboratory report which indicates the <br />possibility of adulteration, the MRO shall review and interpret the <br />laboratory report as follows: <br />Specific gravity <1.003 and creatinine <0.2 g/L - The MRO will <br />report the laboratory findings (including negative result or <br />cancelled test) to Visu-Sewer. Visu-Sewer may require the next <br />specimen submitted by the donor to be collected under direct <br />observation. However, a dilute specimen (SG <1.003 and <br />creatinine <0.2 glL) will not be reasonable suspicion/cause to <br />require the donor to submit to another specimen collection. <br />Specimen not suitable for testing - The MRO will first discuss <br />the test result with the laboratory forensic toxicologist to obtain <br />more specific information about the analysis. The MRO will <br />then contact the donor and inform him/her that the specimen <br />was not suitable for testing and will inquire as to medications <br />(e.9. non-steroidal anti-inflammatory agents) or other medical <br />explanations for the specimen's unsuitability, lf no acceptable <br />39
