The MRO will be authorized to verify a test as positive without having <br />communicated directly with a driver about the results: <br />lf the driver expressly declines the opportunity to discuss the <br />test; or <br />lf, within five days after a documented contact by the <br />designated employer representative instructing the driver to <br />contact the MRO, the driver has not done so. <br />ln the event the MRO reports a positive test result to Visu-Sewer <br />without having discussed it with the driver, the MRO will document his <br />efforts to contact the driver, along with his/her contacts with Visu- <br />Sewer's designated representative. <br />lf a test is verified as positive because of an employee's failure to <br />contact the MRO, the employee will be given an opportunity to provide <br />the MRO with evidence establishing that a serious illness, injury or <br />other circumstance unavoidably prevented him/her from timely <br />contacting the MRO. The MRO may, on the basis of that information, <br />reopen the verification and allow the employee to present information <br />concerning a legitimate explanation for the confirmed positive test. lf <br />the MRO concludes that there is a legitimate explanation, the MRO will <br />declare the test to be negative. <br />Before the MRO verifies a confirmed positive result for opiates, he <br />shall determine that there is clinical evidence, in addition to the urine <br />test, of unauthorized use of any opium, opiate or opium derivative (e.g <br />morphine/codeine). This requirement will not apply if the GC/MS <br />confirmation test for opiates confirms the presence of 6- <br />monocetylmorphine. <br />ln the event a question arises as to the validity or accuracy of a <br />positive test result, the MRO will be authorized to order a reanalysis of <br />the original sample at the same laboratory or an alternative laboratory <br />certified in accordance with DHHS guidelines. However, only the MRO <br />may authorize such a reanalysis, and such a reanalysis may take <br />place only at laboratories certified by DHHS. lf the reanalysis fails to <br />reconfirm the presence of the drug or drug metabolite, the MRO shall <br />cancel the test and report the cancellation and the reasons for it to the <br />DOT, the employer and the employee. When appropriate, the MRO <br />will also receive specific consultation from the laboratory concerning <br />the drug test results as requested by Visu-Sewer. <br />The MRO will also notify each employee who has a verified positive <br />?R <br />a <br />a
