rehabilitation program is subject to follow-up drug and alcohol testing <br />Notification of Testing <br />Visu-Sewer will request employees and prospective employees to submit to testing as <br />established by this Policy. The notification of testing will state the purpose of the testing <br />Employee Consent to Testing <br />Prospective employees and employees will be expected to sign a consent or release form <br />authorizing the collection of the specimen, analysis of the specimen for designated <br />controlled substances, testing of the breath sample and release of the results to <br />Visu-Sewer. The employee will not be required to waive liability with respect to negligence <br />on the part of any person participating in the collection, handling or analysis of the <br />specimen or to indemnify any person for the negligence of others. <br />lf the employee refuses to cooperate during the collection process (e.9., refusal to provide <br />a complete specimen, complete paperwork, initial specimen, provide a breath sample, or <br />othenivise fails to cooperate with the collection process in a way that prevents the <br />completion of the test), the collection site person will inform Visu-Sewer's representative <br />and document the employee's conduct on the Custody and Control Form or Breath Alcohol <br />Testing Form. Any such conduct will constitute a refusal to test. All employees are <br />expected to exercise good faith and cooperate during the collection process. Failure to do <br />so will subject the employee to disciplinary action, up to and including discharge, <br />independent and regardless of the results of any subsequent test. <br />Types of Testing. Pre-Employment'382.601(b) 2, 5, 7 <br />Each job applicant will be advised that a drug and/or alcohol test will be required as <br />a part of pre-placement examination and that any job offer is contingent upon, <br />among other things, a negative test. (APPENDIX A - APPUCANT NOTIFICATION <br />OF Y/S U-S EW E R'S CO N T RO LLED S UBS T A N C E S/ALC O H O L P O U CY) <br />Prospective employees will be notified in advance of said drug and alcohol test. lf <br />the prospective employee refuses to submit to the drug and alcohol test, <br />consideration for employment with Visu-Sewer will immediately cease. A <br />prospective employee will not be allowed to begin work at Visu-Sewer until the <br />results of the drug and alcohol test are known. lf the results of the test are positive, <br />the prospective employee will be denied employment. <br />Random <br />All employees are subject to random drug and/or alcohol tests unless exempt or <br />prohibited by law. All employees in safety-sensitive positions are subject to random <br />testing. Every employee will have an equal chance of being selected to be drug <br />tested each and every time the selection for random testing is conducted. At least <br />25o/o of Visu-Sewer's employees will be randomly tested for controlled substances <br />every twelve months. At least 10% of Visu-Sewer's employees will be randomly <br />tested for alcohol every twelve months. Random testing will take place once per <br />quarter for a total of four times per year.
