REGULAR MEETING <br />APRIL 24, 2000 <br />RESOLUTION NO. 2866-66 A RESOLUTION OF THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA, APPOINTING AN <br />ADVISORY CITY NEGOTIATING TEAM TO <br />REPRESENT THE CITY ADMINISTRATION AND THE <br />COMMON COUNCIL FOR THE 2000 FIREFIGHTER <br />NEGOTIATIONS <br />WHEREAS, the legislative body of the city has the mandatory duty to fix by ordinance the <br />annual compensation formembers of the South Bend Fire Department pursuant to Indiana Code §36- <br />8-3-3(d); and <br />WHEREAS, the Board of Public Safety has the exclusive right and obligation to oversee all <br />matters excluding compensation of the South Bend Fire Department pursuant to Indiana Code § 36- <br />8-3-2(b)(1); and <br />WHEREAS, the City Administration and the Common Council have determined that a <br />unified effort would be in the City of South Bend's best interests when addressing, through the <br />negotiating process, such item's as annual compensation, specialty pays, monetary fringe benefits, <br />working conditions and items related to the sworn members of the South Bend Fire Department; and <br />WHEREAS, the Common Council and the Board of Public Safety will each take formal <br />action by adopting similar resolutions which will officially appoint an advisory city negotiating team <br />which will represent each body, and provide and receive updates during executive sessions called <br />for the purpose of discussing strategy with regard to collective bargaining pursuant to Indiana Code <br />§5- 14- 1.5 -6.1; and <br />WHEREAS, the 1997 -2000 Collective Bargaining Agreement between the City and the <br />South Bend Firefighters' Association Local 362 of the International Association Firefighters AFL - <br />CIO expires at the end of this year, along with Ordinance No. 86 -96 which established the firefighter <br />salaries and monetary fringe benefits for calendar years 1997 through 2000; and <br />WHEREAS, the advisory City negotiating Team shall not be considered a "governing body" <br />or a "public agency" under Indiana Code §5- 14- 1.5 -2. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />Section I. The Common 'Council of the City of South Bend, Indiana, hereby appoints an <br />advisory City Negotiating Team to represent the City Administration and the Common Council for <br />the upcoming labor negotiations with the negotiating team representing the South Bend Firefighters' <br />Association Local #362. <br />Section II. The members of the advisory City Negotiating Team shall be as follows: <br />James Aranowski, Council Member <br />Thomas L. Bodnar, Esquire <br />Kathleen Cekanski - Farrand, Spokesperson <br />Sheryl Green, Esquire <br />Roland Kelly, Council Member & Alternate <br />M. Catherine Roemer, City Controller <br />Andrew Ujdak, Council Member <br />Karen L. White, Council Member <br />Section III.
