REGULAR MEETING APRIL 24, 2000 RESOLUTION NO. 2866-66 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPOINTING AN ADVISORY CITY NEGOTIATING TEAM TO REPRESENT THE CITY ADMINISTRATION AND THE COMMON COUNCIL FOR THE 2000 FIREFIGHTER NEGOTIATIONS WHEREAS, the legislative body of the city has the mandatory duty to fix by ordinance the annual compensation formembers of the South Bend Fire Department pursuant to Indiana Code §36- 8-3-3(d); and WHEREAS, the Board of Public Safety has the exclusive right and obligation to oversee all matters excluding compensation of the South Bend Fire Department pursuant to Indiana Code § 36- 8-3-2(b)(1); and WHEREAS, the City Administration and the Common Council have determined that a unified effort would be in the City of South Bend's best interests when addressing, through the negotiating process, such item's as annual compensation, specialty pays, monetary fringe benefits, working conditions and items related to the sworn members of the South Bend Fire Department; and WHEREAS, the Common Council and the Board of Public Safety will each take formal action by adopting similar resolutions which will officially appoint an advisory city negotiating team which will represent each body, and provide and receive updates during executive sessions called for the purpose of discussing strategy with regard to collective bargaining pursuant to Indiana Code §5- 14- 1.5 -6.1; and WHEREAS, the 1997 -2000 Collective Bargaining Agreement between the City and the South Bend Firefighters' Association Local 362 of the International Association Firefighters AFL - CIO expires at the end of this year, along with Ordinance No. 86 -96 which established the firefighter salaries and monetary fringe benefits for calendar years 1997 through 2000; and WHEREAS, the advisory City negotiating Team shall not be considered a "governing body" or a "public agency" under Indiana Code §5- 14- 1.5 -2. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. The Common 'Council of the City of South Bend, Indiana, hereby appoints an advisory City Negotiating Team to represent the City Administration and the Common Council for the upcoming labor negotiations with the negotiating team representing the South Bend Firefighters' Association Local #362. Section II. The members of the advisory City Negotiating Team shall be as follows: James Aranowski, Council Member Thomas L. Bodnar, Esquire Kathleen Cekanski - Farrand, Spokesperson Sheryl Green, Esquire Roland Kelly, Council Member & Alternate M. Catherine Roemer, City Controller Andrew Ujdak, Council Member Karen L. White, Council Member Section III.
