REGULAR MEETING JANUARY 10, 2000 <br />OF THE PREVIOUSLY VACATED ALLEY FOR A <br />DISTANCE OF 113 FEET AND A WIDTH OF 14 FEET. <br />PART LOCATED IN THE ORIGINAL TOWN OF SOUTH <br />BEND, ST. JOSEPH COUNTY, INDIANA <br />Councilmember Ujdak reported that due to the lack of a quorum at the Public Works and Property <br />Vacation Committee meeting held this afternoon, this bill comes to the Council with no <br />recommendation. <br />At this time, Council Attorney Kathleen Cekanski - Farrand offered the following amended to the bill: <br />Section V: <br />- delete last "and" and add <br />add "," after "Mayor" <br />add at the end the following language: "and subject to the recording of an <br />appropriate access easement approved by the City's Engineering Department." <br />Councilmember Coleman made a motion to accept this amendment as offered. Councilmember <br />Kelly seconded the motion which carried by a voice vote of eight (8) ayes. <br />Mr. Ron Randolph, Plant Manager, South Bend Medical Foundation, 530 North Lafayette <br />Boulevard, South Bend, Indiana, made the presentation for this bill. <br />Mr. Randolph informed the Council that this vacation will allow them to build a canopy on the south <br />side of their building to give their transportation drivers some coverage and also to house mechanical <br />equipment. He noted that the pathway of the traffic will not be changed. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in opposition to this <br />bill, Councilmember Coleman made a motion for favorable recommendation to full Council <br />concerning this bill. Councilmember King seconded the motion which carried by a voice vote of <br />eight (8) ayes. <br />BILL NO. 108 -99 A BILL TO VACATE THE FOLLOWING DESCRIBED <br />PROPERTY: THE FIRST 12 FOOT WIDE NORTH -SOUTH <br />ALLEY LYING WEST OF BURNS STREET, BOUNDED <br />ON THE SOUTH BY THE NORTHERLY RIGHT -OF- <br />WAY LINE OF SOUTH BEND AVENUE AND BOUNDED <br />ON THE NORTH BY THE WESTERLY EXTENSION OF <br />THE NORTH LINE OF LOT 90 AS SHOWN ON THE <br />RECORDED PLAT OF HARTMAN & MILLER'S PLAT <br />AS THE SAME IS RECORDED IN THE OFFICE OF THE <br />RECORDER OF ST. JOSEPH COUNTY, INDIANA. SAID <br />ALLEY TO BE VACATED IS 12 FEET IN WIDTH EAST <br />AND WEST AND EXTENDS 194.2 FEET NORTH (AS <br />MEASURED ALONG ITS CENTERLINE) FROM THE <br />NORTHERLY LINE OF SOUTH BEND AVENUE TO THE <br />END OF THE PROPOSED VACATION <br />It is noted that due to the lack of a quorum at the Public Works and Property Vacation Committee <br />meeting held this afternoon, this bill comes to the Council with no recommendation. <br />Mr. Bernie Feeney, Lang, Feeney & Associates, Inc., 715 South Michigan Street, South Bend, <br />Indiana, made the presentation for this bill on behalf of the Petitioners, James and Theresa Sharpe, <br />805 West Edison Road, Mishawaka, Indiana. <br />
