SAK Construction <br />Pipe Rehab & Tunnel Contractor Health and Safety Plan April 2017 <br />Substance Abuse Policy <br /> <br /> 5 | P a g e <br /> <br /> <br />Accident or Unsafe Practice Testing <br /> <br /> Employees involved in an accident involving injury requiring medical attention (other than <br />minor first aid type treatment) or significant property damage will be tested for the <br />presence of illegal or unauthorized drugs and/or alcohol. Employees who engag e in <br />unsafe conduct or activities posing a danger to themselves, to others or to the overall <br />operation of the Company, will likewise be subject to testing. These provisions are in <br />addition to, and not a limitation of, the provisions for testing based on reasonable <br />suspicion. <br /> <br />Follow-up Testing <br /> <br />If an employee who voluntarily submits to an approved drug and/or alcohol program is <br />permitted to return to work after violation of this policy, such as pursuant to a ‘Last Chance <br />Agreement,’ the employee will be subject to random testing for twenty-four months after <br />their return to work, or longer as deemed necessary by any program guidelines. The <br />reference in this policy to the possibility of a return to work or follow-up testing does not <br />in any way limit the discretion of the Company to discharge an employee for violation of <br />this policy. <br /> <br /> F. Privacy <br /> The Company will use its reasonable efforts to maintain the result of any drug screening <br />in confidence and employees should do the same. The Company recogn izes that <br />persons who do not violate this Policy may be subject to some inconvenience. However, <br />this policy is intended to protect the Company and the safety of all employees, as well as <br />comply with the law, and the Company will make reasonable efforts to minimize any <br />inconvenience. <br /> <br /> G. Investigation and Discipline <br /> The Company reserves the right, at all times while an employee is working and/or is on <br />Company property or Company business, to have management and/or authorized <br />personnel conduct unannounced searches and inspections of employees and their <br />effects, including searches of desks, lockers, briefcases, cases, clothing (including <br />purses), vehicles, and other areas for the purpose of determining if any such person is <br />possessing, using, concealing or distributing any illegal or unauthorized drug and/or <br />alcohol. Nothing herein is intended to limit the rights of the Company to conduct searches <br />to searches for drugs or alcohol. <br /> <br /> Employees are required to fully cooperate with such searches and investigation and the <br />refusal or failure to fully cooperate may result in disciplinary action up to and including <br />discharge.
