The Company may discipline, up to and including discharge, an employee (or <br />refuse to consider or withdraw the conditional offer of an applicant) who refuses to consent <br />or submit to testing under this policy or who at tempts to circumvent or evade accurate <br />test results. The Company may also discipline employees who test positive for the use <br />of prohibited drugs or alcohol in violation of this policy, up to and including discharge, or <br />may require the employee to submit to other conditions, including, but not limited to, <br />referral to an authorized program at the discretion of the Company. However, nothing <br />herein requires the Company to permit an employee who violates this policy to participate <br />in a treatment program or follow-up plan. Any violation of this policy may result in <br />disciplinary action up to and including discharge, even for a first offense. <br /> <br />III. Testing <br /> Testing under this policy will be conducted by an independent facility selected by the <br />Company that conforms to those standards of specimen collection as established by the <br />U.S. Department of Transportation’s Procedures for Transportation Workplace Drug <br />Testing (“DOT Procedures”). <br /> <br /> Drug and/or alcohol testing may be through urine, blood, breath sample, or other analysis <br />to determine the presence of any illegal or unauthorized drug(s) and/or alcohol. A <br />urinalysis drug screen may be used as the standard drug testing method and an evidential <br />breath test as the standard alcohol testing method, although other means of testing may <br />be employed. Consent to collect the sample and perform testing will be obtained and <br />chain of custody collection procedures will be used. Refusal by an applicant/employee to <br />submit to testing under this policy, or attempting to circu mvent or evade accurate test <br />results, may result in the applicant/employee’s immediate discharge. <br /> <br /> The Company will pay all actual costs for drug and/or alcohol testing required by the <br />Company. Employees tested under this policy will be allowed to re turn to work, pending <br />test results, unless the employee has been tested based on reasonable suspicion (as <br />discussed above). Employees will remain on the clock and be paid for all time spent while <br />being tested. Employees will not be paid for time away from work as the result of being <br />sent home based on reasonable suspicion or for time away from work following a positive <br />test. <br /> <br /> A proper chain of custody will be maintained on all samples, including that the employee <br />will sign the sealed sample. At the employee’s written request within 72 hours of the <br />test result, a portion of the original sample, known as a split sample, may be analyzed at <br />a different facility; however, the employee will pay all expenses for such additional <br />analysis and the employee is not permitted to submit a different sample for analysis. <br />The employee may make a written request to obtain a copy of test results.
