SAK Construction <br />Pipe Rehab & Tunnel Contractor Health and Safety Plan April 2017 <br />Substance Abuse Policy <br /> <br /> 4 | P a g e <br /> <br /> <br />Post-Offer/Pre-Employment Testing -- Return to Work Testing <br /> <br /> All prospective employees must produce a negative result to a drug screen prior to <br />starting work for the Company. Failure to submit to the drug screening process when <br />requested or any positive test will result in a withdrawal of the conditional offer of <br />employment. <br /> <br /> All employees returning to work following a layoff or leave of absence lasting more than <br />sixty (60) calendar days will be required to pass a drug screen prior to returning to work. <br />A returning employee who receives a confirmed positive test result will b e subject to <br />disciplinary action, up to and including dismissal. The drug screen must be taken as soon <br />after notification of return to work as possible, and no later than forty-eight (48) hours after <br />notice of such testing. <br /> <br />Random Testing <br /> Even in the absence of the existence of reasonable suspicion to believe an employee <br />may be under the influence of, or impaired by, alcohol or drugs, the Company may require <br />employees to undergo random, unannounced testing. All employees are subject to <br />random, unannounced testing, which could result in testing of any employee, in any <br />department, on any shift. <br />Reasonable Suspicion Testing <br /> <br /> Employees who are suspected of drug or alcohol use in violation of this policy, whether <br />based on conduct, appearance, statements or other factors reasonably suggesting that <br />the employee has used an unauthorized substance in violation of this policy, may be <br />required to immediately report for drug and alcohol testing. <br /> <br /> The criteria for requiring testing may include, but is not limited to, observations of <br />appearance, conduct, behavior, speech, odors, statements by the employee, or if the <br />employee is involved in or causes an accident or on-the-job injury or engages in conduct <br />so that management has a reasonable basis to question the condition of the employee. <br />Employees undergoing a reasonable suspicion testing process will be relieved of duties <br />pending the drug/alcohol test results. <br /> <br /> All employees should immediately report to a supervisor or manager any conduct or <br />behavior by an employee which causes the employee to reasonably suspect a violation <br />of this policy. <br /> <br />
