SAK Construction <br />Pipe Rehab & Tunnel Contractor Health and Safety Plan April 2017 <br />Substance Abuse Policy <br /> <br /> 2 | P a g e <br /> <br /> <br />A. Unlawful Distribution, Dispensation, Possession, or Use Prohibited. <br /> The distribution, sale, dispensation, concealment, possession, or use of any illegal or <br />unauthorized drugs, alcohol, or any form of alcoholic beverage in the workplace or on <br />Company property is prohibited and may result in immediate discharge and/or criminal <br />prosecution. In addition, an employee who is involved in off -the-job illegal drug use or <br />who is arrested for off the-job drug activity may be considered to be in violation of this <br />policy to the extent that, in the sole opinion of the Company, it may impair the employee’s <br />ability to perform the job or may threaten or impair the reputation, integrity, or morale of <br />the Company. <br /> <br />B. Reporting for Duty Under the Influence. <br />Off-the-job alcohol or illegal drug use could adversely affect an employee’s job <br />performance and jeopardize the safety of other employees and the public. Employees <br />are prohibited from reporting for duty or remaining on duty after having used or ingested <br />illegal or unauthorized drugs or alcohol, or while under the influence of such drugs or <br />alcohol. A positive test result based on testing under this policy shall be considered as <br />reporting for duty under the influence. A violation of this Policy, or the Policy’s spirit or <br />intent while working, while on Company property, or while on Company business, is <br />grounds for discipline, up to and including dismissal. <br /> <br /> C. Notification and Maintaining a Drug Free Workplace <br /> The Drug Free Workplace Act of 1988 requires employees to report controlled substance <br />related convictions for conduct that occurs outside of the workplace, including pleas of <br />nolo contendere (i.e., no contest), to the employer within 5 days of the conviction. A plea <br />of guilty or bargaining for a suspended imposition or reduction of sentence is considered <br />a conviction for the purpose of this policy. <br /> <br /> Every employee who observes or has knowledge of an employee (including themselves) <br />who has violated this policy must immediately report such violation to a supervisor or <br />manager. In addition, every employee who observes or has knowledge of an employee <br />(including themselves) using unauthorized drugs or alcohol (or who observes or has <br />knowledge of an employee in an impaired condition which either affects the impaired <br />employee’s ability to perform his or her job duties or poses a hazard to the safety and <br />welfare of the employee or others), must immediately report the incident to a supervisor <br />or manager. Employees should immediately contact Angie Hirtz if they have any <br />questions regarding this policy. <br /> <br /> A limited exception to this policy exists for client entertainment and Company-sponsored <br />social events.
