SAK Construction <br />Pipe Rehab & Tunnel Contractor Health and Safety Plan April 2017 <br />Substance Abuse Policy <br /> <br /> 1 | P a g e <br /> <br /> <br /> <br /> <br />DRUG FREE WORKPLACE AND SUBSTANCE ABUSE POLICY <br /> <br /> I. Purpose <br /> SAK Construction, LLC (“SAK” or “Company”) shares a nationwide concern over the <br />growth of substance abuse within our society. Because of the nature of our business, we <br />have been and continue to be firmly committed to a program of safety with a special <br />concern in the areas of drug and alcohol use and/or abuse. Being under the influence of <br />drugs or alcohol on the job poses safety and health risks, not only to the user but to all <br />those who work with the user. <br /> <br /> SAK recognizes that its own economic interests and future are dependent upon the <br />wellbeing of its employees. In addition, under the Federal Drug -Free Workplace Act of <br />1988 and the Omnibus Transportation Employee Testing Act of 1991, SAK must maintain <br />a drug-free workplace. Accordingly, it is the intent of the Company to maintain, through <br />drug testing and education, a safe, healthful, and drug-free working environment for all of <br />our employees and to protect Company property, equipment, and operations. With these <br />basic objectives in mind, we have reaffirmed our commitment to this Drug-Free Workplace <br />and Substance Abuse Policy (“Policy” or “policy”). This Policy applies to all applicants <br />and employees of the Company. In addition, CDL Drivers and certain other employees <br />are also subject to the SAK Construction, LLC DOT Substance Abuse and Alcohol Misuse <br />Policy (the “DOT Policy”).1 You will be notified if the DOT Policy applies to you. <br />Employees should contact Angie Hirtz if they have any questions regarding this policy. <br /> <br />II. Policy <br /> In order to ensure a safe and efficient work environment, the following policy has been <br />adopted to supplement existing personnel policies, practices, and procedures. This <br />Policy does not prohibit the legitimate use or possession of medication or a controlled <br />chemical substance which is prescribed or authorized by a licensed health care <br />practitioner, provided that the use is consistent with the safe performance of the <br />employee’s duties, as determined by Company management, and the medication or <br />substance is used at the prescribed or authorized dosage. Employees should report <br />prescribed medication to Company management prior to using it while working if the <br />employee has concerns regarding the impact of the medication on safety or the <br />employee’s performance of his/her duties. <br /> <br />1 This Policy and the DOT Policy are separate and distinct policies. Nothing in this <br />Policy does or shall be construed to diminish any aspect of the DOT Policy.
