Mr. Gilot noted the City, in particular Mr. Eric Horvath, the Public Works Director; <br />Councilman Davis; Mr. Mike Schmuhl, Mayor's Office; and Mr. Scott Ford, Community <br />Investment, worked with South Bend Ethanol to come up with a temporary agreement to allow <br />the City to operate their pump to help the approximately thirty (30) homeowners with water and <br />mold issues in this area. Mr. Gilot read the costs to the City will consist of the monthly electric <br />bill which is estimated to be between $6,400.00 and $8,100,00; $1,000.00 per week for security; <br />and half of the electric deposit in the amount of $15,000.00. Mr. Davis thanked the Board for <br />going out of order and presented the Board members with a letter he had prepared addressing this <br />Memorandum of Understanding. Mr. Davis stated some of the concerns were brought out the <br />previous night at the Council's Public Works Committee meeting. He questioned what in this <br />agreement gives the new owners of the property any incentives to find an operator for the plant. <br />He noted they are known as liquidators of material. He questioned if the Board is just buying <br />time and wasting money, noting he would like to see more teeth in the agreement. When the <br />agreement expires in six (6) months, Mr. Davis stated, we will be back to the same situation with <br />flooding of the properties. Mr. Davis stated he did not know if incentives for finding an operator <br />in this agreement could be accomplished today, or if it needed to be addressed in the future, but <br />he thanked the Board for allowing him to voice his and his constituent's concerns. Mr. Gilot <br />asked if anyone else wished to speak. Hearing no one else, Mr. Gilot stated the Board would <br />refer Mr. Davis's letter to Mr. Eric Horvath, Public Works, and Mr. Mike Schmuhl, Mayor's <br />Office. Mr. Gilot added Mr. Davis voiced issues he would like to be resolved, but right now, this <br />is the best agreement the City was able to negotiate after many hours and much work by all. He <br />stated he is recommending the Board act on this now. Therefore, upon a motion by Mr. Gilot, <br />seconded by Mr. Inks and carried, the Board ratified the agreement subject to funding. The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the <br />Tri-County News, which were found to be sufficient.
