3. Information about covered functions which provides sufficient guidance on which <br />portions of the work day the covered employee is required to be in compliance <br />with the AMPP. <br />4. Information concerning covered employee conduct which specifies what is <br />prohibited by the AMPP. <br />5. Circumstances under which a covered employee will be tested for alcohol under <br />the AMPP. <br />6. Procedures that cover: <br />a. Testing for presence of alcohol; <br />b. Protection of employee rights; <br />C. Integrity of breath testing process; <br />d. Safeguarding validity of test results; and <br />e. Assignment of test results to proper employee. <br />7. Information concerning the requirement for a covered employee to submit to <br />various types of alcohol tests. <br />8. Information detailing what constitutes a refusal, and consequences of such refusal. <br />9. Information detailing consequences of covered employees who violate the <br />prohibitions as set forth in the AMPP. It must address removal from performing <br />covered functions and guidance on referral for evaluation and/or treatment. <br />10. Information detailing consequences of covered employees who test at an alcohol <br />concentration of 0.02 or greater but less than 0.04 <br />11. Information detailing alcohol misuse and: <br />a. How it impacts on an individual's health, work and personal life; <br />b. Detecting signs and symptoms of an alcohol problem; and <br />C. Intervening, evaluation and resolving problems associated with alcohol <br />misuse (suspicions, confrontation, referral to SAP and referral to <br />management official). <br />Alcohol Tests Required <br />Random Testing <br />1. The minimum annual percentage rate for random alcohol testing shall be 15 <br />percent of the average number of safety -sensitive positions. <br />2. NOTE: The FHWA Administrator's decision to increase or decrease the <br />minimum annual percentage rate for alcohol testing is based on the reported <br />violation rate for the entire industry. Each year the FHWA Administrator will <br />publish in the Federal Register the minimum annual percentage rate for random <br />alcohol testing of drivers. The new minimum annual percentage rate for random <br />alcohol testing will be applicable starting January 1 of the calendar year following <br />publication. Trisco Systems, Inc. will then adhere to the new percentage rate for <br />random testing. <br />3. The selection of safety -sensitive employees for random alcohol testing shall be <br />made by a scientifically valid method, such as a random number table of a <br />computer based random number generator that is matched with employees' Social <br />Security numbers.
