equal chance of being tested each time selections are made. As Trisco Systems, <br />Inc. Administration conducts random testing for alcohol through a consortium, the <br />number of employees to be tested is based on the total number of employees <br />covered by the consortium who are subject to random alcohol testing at the same <br />minimum annual percentage rate under this rule. <br />4. Trisco Systems, Inc. Safety Manager shall ensure that random alcohol tests <br />conducted under this part are unannounced and that the dates for administering <br />random alcohol tests are spread reasonable throughout the calendar year. <br />5. Trisco Systems, Inc. Safety Manager requires that each employee who is notified <br />of selection for random alcohol testing proceeds to the test site immediately; <br />provided, however that if the employee is performing a safety -sensitive function <br />at the time of notification, the Trisco Systems, Inc. Safety Manager shall instead <br />ensure that the driver ceases to perform the safety -sensitive function and proceeds <br />to the testing site as soon as possible. <br />6. An employee shall only be tested for alcohol while the employee is performing <br />safety -sensitive functions, just before the employee is to perform safety -sensitive <br />functions, or just after the employee has ceased performing safety -sensitive <br />functions. <br />Post Accident Testing <br />l . Trisco Systems, Inc. shall promptly determine and test each covered employee for <br />alcohol if that employee's performance contributed to the accident or cannot be <br />completely discounted as a contributing factor to the accident. The decision not <br />to administer an alcohol test under this section shall be based on the Safety <br />Manager's determination, using the best available information at the time of the <br />determination that the employee's performance could not have contributed to the <br />accident. <br />2. Trisco Systems, Inc. shall conduct an alcohol test within two hours of the <br />accident. If the test is not conducted within two hours of the accident Trisco <br />Systems, Inc. shall prepare and maintain a written document explaining why the <br />test was not conducted. Trisco Systems, Inc. shall continue all efforts to conduct <br />the alcohol test. If the test is not conducted within eight hours Trisco Systems, <br />Inc. shall cease all attempts to conduct the test and shall prepare and maintain <br />written documentation as to why the test was not conducted. <br />3. Employees should make every effort to obtain assistance in responding to an <br />accident, including leaving the scene temporarily for that purpose where <br />absolutely necessary. However, an employee who is subject to post accident <br />testing who fails to remain readily available for such testing, including notifying <br />the Trisco Systems, Inc. representative of their location if they leave the scene of <br />the accident prior to submission of such test, may be deemed by Trisco Systems, <br />Inc. to have refused to submit to testing. <br />4. The employee must remain available for alcohol testing and may not consume any <br />alcohol for 8 hours following the accident or until the alcohol test has been <br />conducted. Notwithstanding the previous statement, employees should seek and <br />obtain emergency medical care whenever necessary. <br />37 <br />
