28 <br />(5) The procedures that will be used to test for the presence of alcohol and <br />controlled substances, protect the employee and the integrity of the testing <br />processes, safeguard the validity of the test results, and ensure that those results <br />are attributed to the correct employee; <br /> <br /> (6) The requirement that an employee submit to alcohol and controlled <br />substances tests administered in accordance with this part; <br /> <br /> (7) An explanation of what constitutes a refusal to submit to an alcohol or <br />controlled substances test and the attendant consequences; <br /> <br /> (8) The consequences for employees found to have violated the drug and <br />alcohol rules, including the requirement that the employee be removed <br />immediately from the job and DOT drivers from safety-sensitive functions, and <br />the procedures under § 382.605; <br /> <br /> (9) The consequences for employees found to have an alcohol <br />concentration of 0.02 or greater but less than 0.04; <br /> <br /> (10) Information concerning the effects of alcohol and controlled <br />substances use on an individual's health, work, and personal life; signs and <br />symptoms of an alcohol or a controlled substances problem; and available <br />methods of intervening when an alcohol or a controlled substances problem is <br />suspected, including confrontation, referral to any employee assistance program <br />and or referral to management. <br /> <br /> (d) Certificate of receipt. Trisco Systems, Inc shall ensure that each employee is required <br />to sign a statement certifying that he or she has received a copy of these materials <br />described in this section. Trisco shall maintain the original of the signed certificate and <br />may provide a copy of the certificate to the employee. <br /> <br />Education therefore shall include at least the following elements: <br /> <br />1 Display and distribution of informational materials; <br />2 Display and distribution of a community service hotline telephone number for <br />employee assistance; and <br />3 Display and distribution of Trisco System Inc.’s Drugs, Narcotics, and Alcohol <br />Policy regarding the use of prohibited substances. <br /> <br />Training shall include at least the following elements: <br /> <br />Training for supervisory personnel (who will determine whether an employee must be <br />drug tested based on reasonable cause) shall include an initial 4-hour training session on <br />the specific, contemporaneous physical, behavioral, and performance indicators of <br />probable drug use with a 1-hour yearly refresher session. All field personnel will attend a <br />1-hour drug abuse session annually.
