29 <br />The following supervisory personnel shall receive the aforementioned training: <br /> <br /> A. All Trisco Systems Inc. Managers (Sales, Production, Office, and Project) <br /> B. Safety Director <br /> C. Job Site Foremen and Superintendents <br /> <br />Recordkeeping <br /> <br />In order to verify that the Company’s Drug Policy is being followed, Trisco Systems, Inc. shall <br />keep the following records for the periods specified and permit access to the records as provided <br />by law: <br /> <br />1 Records that demonstrate the collection process conforming to this policy must be kept <br />for at least 3 years; <br />2 Records of employee drug test results that show employees failed a drug test, and the <br />type of test failed (e.g., post accident), and records that demonstrate rehabilitation, if any, <br />must be kept for at least 5 years, and include the following information: (I) The functions <br />performed by the employee who failed a drug test; (ii) The prohibited drug(s) which were <br />used by the employee who failed a drug test; and (iii) The disposition of the employee <br />who failed a drug test (e.g., termination, rehabilitation, leave without pay, etc.). <br />3 Records of employee drug test results that show an employee passed a drug test must be <br />kept for at least 1 year. <br />4 A record of the number of employees tested, by the type of test (e.g., post accident), must <br />be kept for at least 5 years; and <br />5 Records confirming that supervisory personnel and employees have been trained as <br />required by this policy must be kept for at least 3 years. <br /> <br />Privacy and Confidentiality <br /> <br />With the exception of the testing laboratory, the MRO, and the Trisco Systems, Inc. Supervisor, <br />information regarding an individual’s drug testing results or rehabilitation may be released only <br />upon the written consent of the individual, except that such information must be released <br />regardless of consent to a DOT agency or other Federal safety agency or the representative of a <br />state agency upon request as part of an accident investigation. Statistical data related to drug <br />testing and rehabilitation that is not name specific and training records must be made available to <br />the DOT upon request. <br /> <br />To maintain confidentiality, written records shall be stored in locked containers or in a secured <br />location. <br /> <br />The MRO may disclose such information to the employer, a DOT agency or other Federal safety <br />agency, or a physician responsible for determining the medical qualification of the employee <br />under an applicable DOT agency regulation, as applicable, only if--(1) An applicable DOT <br />regulation permits or requires such disclosure; (2) In the MRO’s reasonable medical judgment, <br />the information could result in the employee being determined to be medically unqualified under <br />an applicable DOT agency rule; or (3) In the MRO’s reasonable medical judgment , in a situation
