The award of the contract will be made within a maximum time of sixty (60) <br />calendar days from the submittal date. The County reserves the right to hold <br />the bids until the award of the contract. <br /> <br />4. The Engineer shall approve all sub-contractors submitted by the Contractor. <br /> <br />5. Upon award, the Engineer shall submit Contract Documents to the <br />Contractor. Contract Documents include the Contract, Payment and <br />Performance Bonds, and a 3-year Maintenance Bond. <br /> <br />XIII. LIQUIDATED DAMAGES <br /> <br />A. 2022 INDOT Standard Specification: 108 <br /> <br />B. Additions: <br /> <br />1. The time of beginning and the time of completing the work are essential <br />conditions of the Contract. Should the Contractor fail to complete the work <br />within the time stipulated, or within any extensions thereof granted by the <br />Owner, there shall be a deduction in the amount otherwise due the <br />Contractor, not as penalty, but as ascertained and liquidated damages, for <br />each and every day that the Contractor shall be in default after the time <br />stipulated, or as extended, in the amount of $500.00 per day. <br /> <br />2. Any liquidated damages due the Owner shall be deducted from the final <br />payment due the Contractor. Should the amount otherwise due the <br />Contractor be less than the amount of such liquidated damages, the <br />Contractor and his surety shall be liable to the Owner for such deficiency. <br /> <br />3. Lost time shall not be included in the computation of Contract time, and <br />liquidated damages shall not be assessed against the Contractor for that day’s <br />delay when the loss of the day's work is due to an unforeseeable cause <br />beyond the control and without the fault or negligence of the Contractor. <br />Such unforeseeable causes shall include but not necessarily be restricted to <br />the following: <br /> <br />a. Acts of God, acts of the public enemy, acts of the Owner except as <br />provided in the Contract Documents, acts of another contractor in the <br />performance of a Contract with the Owner, riots, strikes, epidemics, <br />quarantine restrictions, freight embargoes, fires, floods, and <br />unusually severe weather that precludes efficient work progress. <br /> <br />b. Delays to subcontractors or suppliers for any of the causes listed in <br />subparagraph 3. (a) above when such delays have consequential <br />effect upon the completion of the work. <br /> <br />4. The Inspector or other authorized representative of the Owner shall keep a <br />written record of each day sufficient for his determination as to the inclusion <br />of that day in the computation of Contract time. Where no provision for full <br />time inspection is made, local weather records will be used to determine lost <br />days. This record shall be available for examination by the Contractor during <br />normal hours of work. In case of disagreement between the representative of
