Zoning and Annexation Committee <br /> April 13, 1998 <br /> Page 2 <br /> Mr. James Voll noted that this is an Area Plan Commission and the APC staff send the <br /> measure to the Council with a favorable recommendation. <br /> Dean Carlson,the Engineer for the proposed Walmart Super Center,made the presentation. <br /> In response to a question from Doug Carpender it was noted that signals are being <br /> proposed for the area and that they are working with the City Engineer. <br /> Following discussion, Citizen Member Carpender made a motion, seconded by Council <br /> Member Pfeifer that substitute Bill No. 19-98 be recommended favorable to Council. The <br /> motion passed. <br /> The Committee then reviewed substitute Bill No. 22-98 which is a zoning request for the <br /> property located at 150 West Angela. <br /> Mr. James Voll noted that this is an Area Plan Commission and the APC staff send the <br /> measure to the Council with a favorable recommendation. <br /> II' Gail Alexander of Re-Max Realty made the presentation. She noted that increased <br /> screening would be installed. She stated that "0" Office zoning is being requested and that <br /> the area would act as a transition area from the high school to the north and the bank to the <br /> east,with single family homes to the south and west. <br /> Council Member Broden noted that signage was concern as well as lighting of the sign. <br /> He was assured that the petitioner would comply with all regulations in those areas. <br /> Following discussion, Council Member Broden made a motion, seconded by Citizen <br /> Member Doug Carpender that substitute Bill NO. 22-98 be recommended favorable to <br /> Council. The motion passed. <br /> The Committee then reviewed Bill No. 23-98 which is a rezoning request for the property <br /> located at the southeast corner of McKinley Avenue and Boulevard de la Paix. <br /> Mr. James Voll noted that this is an Area Plan Commission and the APC staff send the <br /> measure to the Council with a favorable recommendation. <br /> Mr. Kevin Butler, the attorney for the petitioner, introduced Marilyn Gardner, the <br /> Executive Director of the Jewish Federation of St. Joseph Valley, Inc. Mr. Butler then <br /> made the presentation. He noted that the Jewish Federation would be relocating its <br /> administrative offices from the downtown to this area. Additionally, a ball diamond is <br /> proposed for 16 year olds and younger who are members. There would be not lights at the <br /> ball diamond and the trees would remain as a buffer. The proposed philanthropic use was <br /> approved by the Building Commissioner Don Fozo. Mr. Butler noted that they held a <br /> meeting with the neighbors to discuss the proposed project. <br /> Mr. Kyle Payne spoke against the proposed rezoning. He provided a letter dated April 9, <br /> 1998 to the Committee(copy attached). <br /> Council Member Kelly spoke in favor of the proposed rezoning. He noted that he lives <br /> near School Field which is a considerably more intense rise. <br />
