REGULAR MEETING April 11, 2022 <br /> <br />6 <br /> <br />Councilmember Lori Hamann responds Bill No. 11-22 came before the Zoning and Annexation <br />Committee and comes to the Committee of the Whole with a favorable recommendation. <br />Councilmember Lee requests for the petitioner. <br />Joseph Molnar, Department of Community Investment, offices located on the 14th floor of the <br />County City Building. Molnar states the bill is a special exception for property located at 1033 <br />Oak St in Lincoln Park Neighborhood and requesting to allow for a duplex in a U-1 urban <br />neighborhood one zoned parcel. Property was illegally converted into a duplex which owner <br />discovered. <br />Councilmember Lee requests Council questions and public wishing to speak in favor or opposition <br />of Bill No. 11-22. <br />Clerk Dawn Jones responds no one is wishing to speak in favor or opposition to Bill No. 11-22. <br />Councilmember Lee entertains a motion to send Bill No. 11-22 to full council. <br />President Sharon McBride motions. <br />Council Hamann Seconds. <br />Clerk Jones responds nine (9) ayes. <br />Councilmember Lee responds Bill No. 11-22 will be sent to the full council with a favorable <br />recommendation. <br />14-22 PUBLIC HEARING ON AN <br />ORDINANCE OF THE COMMON <br />COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, AMENDING THE <br />SOUTH BEND MUNICIPAL CODE AT <br />CHAPTER 2, ARTICLE 9, SECTION 2- <br />129 TO CHANGE THE RESIDENCY <br />RESTRICTION OF COMMISSION <br />MEMBERS <br />Councilmember Canneth Lee request committee report. <br />Councilmember Karen White responds Bill No. 14-22 was sent to the Committee of the Whole <br />with a favorable recommendation. <br />Councilmember Lee requests for petitioner. <br />Yolanda Young-Smith, Executive Director of the Human Rights Commission, 319 N. Niles Ave, <br />South Bend, IN 46617. <br />Aladean De Rose, City Attorney, offices located on the 12th floor of the County City Building. De <br />Rose states that the ordinance requires all members of the Commission to be residents of the City <br />of South Bend. Restrictions have proven difficult due to residents who may be interested in serving <br />that live outside city limits. The Human Rights Ordinance that has been adopted by the county <br />and the city is enabled to enforce the ordinance outside the city limits. The Commission enforces <br />cases outside city limits and suggests representation from residents who live outside the city limits. <br />The ordinance limits talent and are recommending amending Chapter 2, Article 9 Section 2 -129 <br />to allow Commission members to reside outside of the City of South Bend. <br />President Sharon McBride requests information on the inner local agreement. <br />Aladean De Rose responds the agreement prohibits discriminatory practices throughout the county <br />which is equivalent to the city. The purpose is to allow investigation of the county under the city <br />ordinances. The agreement is for the city to serve as investigators for county cases and continues <br />indefinitely so long as it is working. <br />Yolanda Young-Smith presents the need for the change in connection to Aladean De Rose <br />presentation.
