1 <br /> Zoning and Vacation Committee <br /> May 20, 1991 <br /> Page 2 <br /> Following further discussion, Council President Niezgodski <br /> made a motion seconded by Council Member Zakrzewski that <br /> Amended Bill 16-91 be recommended favorably to Council. The <br /> motion passed. <br /> The next item reviewed by the Committee was Amended Bill No. <br /> 17-91 which is a proposed rezoning for the property located <br /> at the southwest corner of the intersection of Jackson and <br /> Miami. Mr. Bernie Feeney of Lang, Feeney and Associates, <br /> Inc. , gave the presentation on behalf of Rojo Development, <br /> Inc. for the establishment of Hermitage South Estates. He <br /> noted that two previous annexations were involved with the <br /> first annexing into the City the eastern portion, and the <br /> second annexation becoming effective last Wednesday, May 15, <br /> 1991. The rezoning request is for "Al"- and "B-Residential". <br /> He further noted that in 1987 the South Bend Development <br /> Corporation purchased the property. Mr. Jack Hickey <br /> purchased the balance of it in 1990. Leroy Troyer and <br /> Associates developed the drainage plans, which call for five <br /> retention basins of which three have been constructed and <br /> are currently working. For a considerable period of time, <br /> Lang, Feeney and Associates have worked closely with the <br /> Area Plan staff and the City Engineering staff. They have <br /> proposed buffering the existing Residential with <br /> Residential. The County Engineer and the County Surveyor <br /> have approved the drainage proposals. Their plan proposes <br /> 2 . 3 times more drainage than what was originally proposed by <br /> the former developer. Mr. Feeney also noted that a side <br /> ditch along Johnson Road and Swales, have been incorporated <br /> so that water would not flow to impact Hay School. He also <br /> noted that an 18 inch culvert off of Miami would be plugged, <br /> thus placing 33 acres of water shed away from the Fairfax <br /> area. <br /> Council Slavinskas stated that the flow has stopped <br /> considerably since work has begun in this area. Mr. Feeney <br /> noted that the bottoms of retention basins would be lined, <br /> and that letters from the County Surveyor dated April 15th <br /> and From the Department of Public Works dated April 26th, <br /> are in favor of the drainage proposals. He stated that there <br /> was no remonstrance at the Area Plan meeting. Council Member <br /> Slavinskas also stated also that he has received no <br /> remonstrance calls. <br /> Mr. Feeney summarized by stating that all condominiums would <br /> be owner occupied. Within the "A-1" Duplex area, it would <br /> consist of 26.8 acres with 65 buildings, 106 units, with 4 <br /> units per acre. Within the "B-Residential" area it would be <br /> constructed on 8. 35 acres, incorporating 13 buildings with <br /> 48 units and not quite 6 units per acre. He showed a <br />
