The Office of Diversity and Inclusion has the responsibility of assisting all other city <br />departments in the pursuit of equitable business practices, especially in terms of restorative justice and <br />economics. In terms of policymaking, the landmark passage of the MWBE Program Ordinance in 2019 <br />and 2021, creates the legal framework for contracting with the City of South Bend for amounts over <br />$50,000. This policy was adopted based upon the Croson V. City of Richmond case decided by the United <br />States Supreme Court. Certification of minority and women business enterprises is verified by various <br />organizations throughout the country. The City of South Bend’s program recognizes certifications issued <br />from the following: Mid-State Minority Supplier Diversity Council, City of Indianapolis, Indiana <br />Department of Transportation, WBENC issued by the Great Lakes Women’s Business Council, and <br />Indiana’s Department of Administration. While these certifications are integral to the prime contracting <br />community that work on Public Works projects and other large City of South Bend funded projects <br />containing contract-specific goals, certification status is not a part of the decision-making process when <br />contracting with the City of South Bend on projects not containing MWBE goals. <br />While analysis is done annually to determine the amount of spending which is done as a result of <br />Subsection 5b of the MWBE Program Plan and Ordinance, certified data is primarily used in the <br />calculation of the City of South Bend’s progress towards its Aspirational Spending Goal pursuant to the <br />Disparity Study and applicable caselaw. <br />In terms of restorative economics, the City of South Bend has recently commissioned and completed two <br />studies of the city-wide economics and consistently monitors the amount of spending the city does with <br />minority and women-owned businesses. Restorative economics begins with the economic participation <br />efforts and the real revenue generated by businesses owned by protected class members of our <br />community. To better understand and communicate the outcomes of these efforts, the City of South Bend <br />is building an external facing dashboard which will allow residents to see up-to-date spending activity <br />with Minority and Women throughout all City Departments. <br /> <br /> <br /> <br />
