pay for all subsequent Observed Follow -Up Testing and <br />any Observed RTD Test(s), and shall require the <br />Employee to return to the EAP for further evaluation <br />and treatment. <br />• If the Observed RTD Test is a confirmed Non -Negative <br />Test, Positive Test, or Diluted Retest, it shall be a <br />Non -Compliant Event, it shall constitute a "strike" for <br />purposes of the 3 Strike Rule, it shall require the <br />Employee to pay for all subsequent Observed Follow -Up <br />Testing and any Observed RTD Test(s) in addition to <br />the cost of the initial Observed RTD Test and shall <br />require the Employee to return to the EAP for further <br />evaluation and treatment. <br />These policies and procedures apply each time that an Employee <br />has been N/A for the one (1) year time period pursuant to the 3 <br />Strike Rule and thereafter, requests a change in status under the <br />BCRC Policy Therefore, if an Employee has a second one (1) year <br />suspension pursuant to the 3 Strike Rule and thereafter requests a <br />change in status under the BCRC Policy, BCRC will pay for any <br />Observed Follow -Up Testing if the Observed RTD Test is <br />negative, unless and until the Employee has a subsequent confirmed <br />Non -Negative or Positive Test or other Non -Compliant Event. <br />In such case, the Employee shall pay all costs for: <br />• Any Observed Return To Duty Test(s), <br />• Any Dilute Retest Under Observation, <br />• Any Observed Follow -Up Testing required by the EAP, <br />• Any subsequent testing required by the EAP. <br />OBSERVED RETURN TO DUTY TESTING <br />Observed Return To Duty test is required for an Employee to be <br />reinstated into the BCRC program following any Non -Compliant <br />Event (e.g., missed random, walkout, refusal to submit, etc.) as <br />described in the Definitions of this BCRC Policy.
