are referred to in this BCRC Policy as the "3 Strike Rule." <br />In addition, such Employee must complete an EAP -prescribed <br />treatment program before returning to work. <br />BCRC also performs On -Site Random Testing pursuant to the <br />BCRC On -Site Substance Abuse Testing Addendum. The <br />policies set forth in such Addendum (and/or other testing <br />agreements with Owners) also impose additional consequences <br />for Positive Tests and/or other Non -Compliant Events. Such <br />additional consequences generally apply at the specific plants <br />and locations covered by such Addenda (and/or other testing <br />agreements with owners) and are in addition to any additional <br />consequences set forth in this BCRC Policy. <br />After an Employee has been N/A for the one (1) year time period <br />pursuant to the 3 Strike Rule, the Employee can request a change <br />in status under the BCRC Policy. If such a request is made by the <br />Employee, the following shall apply: <br />• The Employee shall report to the EAP and comply with <br />all requirements of the EAP. <br />At the direction of the EAP, the Employee shall submit <br />to an Observed RTD Test at the Employee's expense, <br />which test shall be taken within the time periods and <br />requirements established by the EAP. After the BCRC <br />has scheduled the observed test, the obligation to inform <br />the collection site of the requirement for an observed test <br />shall lie solely with the Employee. <br />• If the Observed RTD Test is negative, BCRC will pay <br />for any Observed Follow -Up Testing, unless and until the <br />Employee has a subsequent confirmed Non -Compliant <br />Event. Any subsequent confirmed Non -Compliant <br />Event following the negative Observed RTD Test <br />shall constitute a "strike" for purposes of the 3 Strike <br />Rule, shall require the Employee (and not BCRC) to <br />43 <br />
