any Observed Follow -Up Testing or any Observed <br />Retests for a Diluted Specimen, <br />• Failure to report for a random test request within <br />seven (7) days, or <br />• Failure to submit to a drug or alcohol test when <br />requested to do so by the EAP. <br />5. If a New Employee/Applicant/Traveler has an initial <br />drug or alcohol test that is confirmed as a Positive Test, <br />BCRC shall notify the applicable Local Union or <br />Contractor Participant of the test results and the <br />applicable Local Union or Contractor Participant shall <br />advise BCRC as to the Local Union's or Contractor <br />Participant's intent and decision regarding such New <br />Employee/Applicant/Traveler. If the Local Union or <br />Contractor Participant decides to keep such New <br />Employee/Applicant/Traveler, the New Employee/ <br />Applicant/Traveler shall pay all costs for: <br />• Any Observed Return To Duty Test(s), <br />• Any Observed Follow -Up Testing required by the EAP, <br />• Any subsequent testing required to be in compliance <br />with the BCRC Policy. <br />• Any costs associated with the Observed Return To <br />Duty or the Observed Follow -Up tests including a <br />retest for dilute will be the obligation of the employee. <br />ADDITIONAL CONSEQUENCES FOR MULTIPLE <br />NON-COMPLIANT EVENTS <br />If any Employee has three (3) or more Non -Compliant Events <br />within a twelve (12) consecutive month (rolling) period, the <br />Employee shall not be permitted to take a Return To Duty Test <br />until one (1) year after the most recent Non -Compliant Event <br />within such twelve (12) consecutive month period and the <br />Employee's BCRC Substance Abuse Card and status shall be <br />N/A for the same time period.
