the MRO will downgrade the result to a negative, and <br />the Employee's card will be marked "CU. <br />2. In the case of a confirmed Non -Negative or Positive <br />drug or alcohol test, the TPA (B CRC) will be notified <br />that the Employee's status should be marked "N/A'. <br />The "N/A'status will be effective at the moment that a <br />confirmed Non -Negative or Positive Test is received. <br />3. Before returning to work, an Employee must: <br />• (1) Complete an evaluation with the program's <br />Employee Assistance Program provided by the <br />BCRC EAP Provider; <br />(2) Follow a treatment plan prescribed by the <br />program's EAP; <br />• (3) Obtain written documentation from the <br />program's EAP verifying an Observed Return To <br />Duty Test date; and <br />• (4) Obtain a negative result on an Observed Return <br />To Duty Test. The specimen for all Return To Duty <br />Tests shall be given pursuant to observed collection <br />protocol and procedures. After the BCRC has <br />scheduled the observed test, the obligation to inform <br />the collection site of the requirement for an observed <br />test shall lie solely with the Employee. <br />4. An "N/A" status will not be the sole basis for termination <br />of employment. An Employee must contact the BCRC <br />office to resolve an "N/A" status. Only Employees who <br />are in non-compliance with this BCRC Policy may be <br />discharged. For the purposes of this provision, <br />"non-compliance" shall mean one or more of the following: <br />• Failure to report to the program's Employee <br />Assistance Program as directed, <br />• Failure to follow and/or complete an EAP -prescribed <br />treatment program, <br />• Failure to take an Observed Return To Duty Test or <br />41 <br />
