However, these procedures shall not <br />prohibit the specimen collector from immediately conducting a <br />new collection using direct observation procedures in those cases <br />where required by law. <br />In those cases where the MRO is unable to determine whether <br />a specimen is an Adulterated Specimen and/or a Substituted <br />Specimen, the MRO directs a retest under direct observation <br />because the creatinine concentration of the specimen was not <br />consistent with medical expectations for human urine. The <br />Employee shall be required to submit to immediate recollection <br />pursuant to observed collection protocol and procedures without <br />any prior notification to the Employee. After the BCRC has <br />scheduled the observed test, the obligation to inform the <br />collection site of the requirement for an observed test shall lie <br />solely with the Employee. <br />In addition, the Employee who has refused to be tested, or who <br />uses or possesses a counterfeit drug card, shall be subject to <br />Employer discipline up to and including discharge, subject to t <br />he grievance procedures set forth in the applicable Union's <br />Collective Bargaining Agreements. <br />CONSEQUENCES FORA NON -NEGATIVE OR <br />POSITIVETEST <br />1. An Employee who tests Non -Negative or Positive for <br />drugs shall be contacted directly by the Medical Review <br />Officer (MRO). If the MRO verifies the results of <br />the Non -Negative or Positive Test, the MRO will notify <br />the Employee that he or she is ineligible for work and <br />he/she will be directed to contact the TPA (BCRC). <br />The BCRC will refer the Employee to the program's <br />Employee Assistance Program (EAP) for consultation <br />and review. If the MRO contacts the Employee and <br />finds that there is a reason for the Non -Negative or <br />Positive Test (i.e., an authorized prescription medication) <br />.E <br />
