Upon receipt of a timely and proper written request for review, <br />the Review Board shall perform the requested review. In performing <br />the requested review, the Review Board (or any member or <br />designated representative thereof) may, but is not required to, <br />request additional information, obtain additional information, <br />conduct interviews, hold hearings, and utilize any other procedures <br />and/or methods that the Review Board deems appropriate. Any <br />decisions of the Review Board shall be made by a majority vote <br />of the members of the Review Board. Upon making any decision, <br />the Review Board shall provide a written notice of such decision <br />to the Employee, Contractor Participant, or Union that requested <br />the review. Such written notice shall contain a description of the <br />decision. The written notice may also contain a statement and/or <br />summary of the reasons for the decision, but such a statement or <br />summary is not required. <br />Any decisions of the Review Board that relate to the interpretation <br />and/or implementation of the BCRC Policy shall be final and <br />binding and not subject to further review. However, any decisions <br />of the Review Board that relate to compliance with federal, state, <br />or local statutes, ordinances, and other laws may be submitted to <br />binding arbitration pursuant to the Labor Arbitration Rules and <br />Procedures of the American Arbitration Association (hereinafter <br />"AAA"). Any such submission must be initiated within thirty (30) <br />calendar days after the decision of the Review Board by filing a <br />Demand for Arbitration with the AAA, paying the appropriate <br />filing fees to the AAA, serving a copy of the Demand for Arbitration <br />upon the Executive Director of the BCRC, and serving a copy <br />of the Demand for Arbitration upon any other interested parties <br />who were named in and/or who directly participated in the review <br />conducted by the Review Board. If the thirtieth day is on a weekend <br />or holiday, then the time period for requesting review shall be <br />extended to the immediately following business day. <br />In any such arbitration, the arbitrator (i.e., neutral) shall be bound <br />substantively by the provisions of this BCRC Policy. All of the <br />fees and expenses of the AAA and the arbitrator shall be paid by <br />W •V <br />
