the party filing the Demand for Arbitration, unless the arbitrator <br />makes a different allocation in his/her award. Each party to the <br />arbitration shall pay their own attorney fees and attorney expenses <br />relating to the arbitration, and the arbitrator shall not have any <br />authority: (1) to make any award for attorney fees and attorney <br />expenses, or (2) to require any party to reimburse another party <br />for attorney fees and attorney expenses. <br />ILLINOIS — "DRUG FREE WORKPLACE ACT" - <br />30 ILCS 580 <br />When working on public projects in the State of Illinois, <br />Employers must comply with the Illinois Drug Free Workplace <br />Act. This Act requires Employers to certify that it provides a drug <br />free workplace by complying with certain steps. First, the <br />Employer must publish a statement to its Employees notifying <br />them that as a condition of employment, drug possession, use, <br />etc. is prohibited at work and specify the actions taken if this <br />is violated. Second, Employers must provide each Employee <br />working in Illinois a copy of this published statement. Third, <br />Illinois requires Employers to provide a drug free awareness <br />program to inform Employees about drug abuse, the Employer's <br />drug free policy, the availability of drug assistance programs, and <br />penalties for drug violations. If the Employer receives notice of an <br />Employee's criminal drug conviction, the Employer must notify <br />the Illinois agency in the contract within ten (10) days. Finally, if <br />an Employee violates the drug free policy, an Employer has thirty <br />(30) days to take action against the Employee, up to and including <br />termination or requires the Employee to satisfactorily participate <br />in an approved drug abuse assistance program. <br />If the Employer fails to follow the Drug Free Workplace Act <br />provisions, the Illinois agency in the contract may suspend or <br />terminate the contract. If the violation is serious, the Illinois <br />agency may recommend debarment, which makes the Employer <br />ineligible to be awarded any contract or grant by the State of <br />Illinois for one to five (1-5) years. <br />Me] <br />
