APPEALS AND PROTECTIONSJUST CAUSE <br />Employees who are subject to this BCRC Policy continue to have <br />access to the usual protections provided as a part of their Union <br />membership and/or as members of bargaining units covered by <br />Collective Bargaining Agreements. Such Employees may request <br />that a Union Representative be available or present prior to any <br />action taken by an Employer, if any, at any stage of the policy <br />and its administration. If an Employee is aggrieved by any action <br />taken under this BCRC Policy and his/her complaint cannot be <br />resolved, the complaint may, if the Employee or Union requests, <br />be referred as a grievance under the grievance and arbitration <br />provisions of the Employee's Collective Bargaining Agreement. In <br />the event the matter is referred to arbitration, the arbitrator shall <br />be bound substantively by the provisions of this BCRC Policy. <br />Any Employee, Contractor Participant, or Union shall have the <br />right to have any decision, action, or other matter relating to the <br />implementation of this BCRC Policy reviewed by the Board of <br />Directors of BCRC (or a committee appointed by said Board) <br />(hereinafter "Review Board") in accordance with the following <br />procedures. Within thirty (30) calendar days of the decision, <br />action, or other matter for which such review is requested, any <br />Employee, Contractor Participant, or Union may submit a written <br />request for review to the Executive Director of BCRC. The <br />written request shall describe: (1) the decision, action, or other <br />matter to be reviewed, (2) the reason for the requested review, <br />and (3) the requested relief. <br />The thirty (30) calendar day time period shall begin to run on <br />the date of the occurrence of the decision, action, or other matter <br />for which such review is requested, or if the decision, action, or <br />other matter is continuing in nature, then the thirty (30) day time <br />period shall begin to run on the first day of the decision, action, or <br />other matter. If the thirtieth day is on a weekend or holiday, then <br />the time period for requesting review shall be extended to the <br />immediately following business day. <br />47 <br />
