SECTION 1 – GENERAL MISCELLANEOUS <br />7 <br />(2) working days (Monday – Friday) prior to start. No work shall commence within this two <br />(2) day notification period. <br />1-11.1 (c) ACCEPTANCE OF IMPROVEMENTS <br />1.Upon completion of work <br />a.The Developer shall request a Final Inspection and acceptance by the Engineer <br />b.The Developer shall submit their request for acceptance of the improvements to the <br />City Engineer’s Office along with the following documents: <br />i.As-Built Plans: The as-built plans shall be in accordance with Section 2090 <br />in the Prevailing and Supplemental Specifications. <br />ii.Waiver of Lien: On all workmanship and materials used in connection <br />with these improvements. <br />iii.Maintenance Bond, as per section 103.04 of the City’s Prevailing <br />and Supplemental Specifications. <br />iv.Completion Affidavit, as furnished by the Board of Public Works. <br />Items a and b.ii. above shall list the Developer as the 1st party to all documents. <br />Maintenance Bonds and Completion Affidavits will not be accepted from individual <br />contractors or service firms. <br />2.Uncompleted Work <br />a.A cost estimate for the balance of work will need to be approved by the Department <br />of Engineering. Surety will be posted for 125% of the approved cost estimate. The <br />Developer or Private Party shall contact the City and notify them within six (6) <br />months of the expiration of the Surety. <br />b.Should acceptance by the Board of Public Works be requested by the Private Party <br />or Developer prior to the completion of all improvements, a Modified Completion <br />Affidavit may be issued at the discretion of the Engineer. This will require posting <br />with the Board of Public Works one of the following items to insure completion of <br />the balance of all improvements: <br />i.Certified Letter of Credit <br />ii.Certified Check <br />iii.Performance Bond <br />iv.Any equally negotiable instrument equal to (i) or (ii), <br />v.All such instruments in the amount of 125% of the uncompleted <br />improvements. <br />vi.The instrument shall be issued in perpetuity and shall NOT have an expiration <br />date. <br />vii.It will be released upon final acceptance of the proposed improvements and <br />then a Completion Affidavit and Maintenance Bond will need to be submitted <br />to the Board of Public Works for Approval.
