Failure to complete a wastewater discharge survey or the wastewater discharge <br />permit application; <br />xii. Failure to provide advance notice of the transfer of business ownership of a <br />permitted facility; or <br />xiii. Violation of any Pretreatment Standard or Requirement, or any terms of this <br />permit or Chapter 17 of the City of South Bend’s Municipal Code. <br /> <br />10. Confidentiality <br /> <br />a. Information and data on a permittee obtained from reports, surveys, wastewater <br />discharge permit applications, individual wastewater discharge permits and <br />monitoring programs, and from the Director’s inspection and sampling activities, shall <br />be available to the public without restriction, unless the permittee specifically <br />requests, and demonstrates, to the satisfaction of the Director, that the release of such <br />information would divulge information, processes, or methods of production entitled <br />to protection as trade secrets under the Indiana Access to Public Records Act (IC 5- <br />14-3-4(A)(4)). Any such request must be asserted at the time of submission of the <br />information or data by stamping the words “confidential business information” on <br />each page containing such information. When requested and demonstrated by the <br />permittee furnishing a report that such information should be held confidential, the <br />portions of a report which might disclose trade secrets or secret processes shall not be <br />made available for inspection by the public, but shall be made available immediately <br />upon request to governmental agencies for uses related to the NPDES program or <br />pretreatment program, and in enforcement proceedings involving the person <br />furnishing the report. <br /> <br />b. Wastewater constituents and characteristics and other effluent data, as defined at 40 <br />CFR 2.302 shall not be recognized as confidential information and shall be available <br />to the public without restriction. <br /> <br />c. All other information which is submitted to the State or Board of Public Works shall <br />be available to the public at least to the extent provided by 40 CFR 2.302. <br /> <br />11. Transfer of Ownership or Control <br /> <br />a. This permit may be transferred to a new owner or operator only if the permittee gives <br />at least thirty (30) days advance notice to the Director and the Director approves the <br />individual wastewater discharge permit transfer. The notice to the Director must <br />include a written certification by the new owner or operator which: <br /> <br />i. Identifies the new owner or operator, including address and telephone <br />number; <br />ii. Identifies the Authorized Representative for the new owner or operator in <br />accordance with Part IV (B)(15) of this permit, including telephone number <br />and email address;
