States that the new owner and/or operator has no immediate intent to change <br />the facility’s operations and processes; <br />iv. Identifies the specific date on which the transfer is to occur; and <br />v. Acknowledges full responsibility for complying with the existing individual <br />wastewater discharge permit. <br /> <br />b. Failure to provide advance notice of a transfer renders this permit void as of the date <br />of transfer. <br /> <br />12. Reopening Clause <br /> <br />a. This permit shall be modified, or alternatively, revoked and reissued, to comply with <br />any applicable effluent limitation or standard issued or approved under section 307(b) <br />of the Clean Water Act if the effluent limitation or standard so issued or approved: <br /> <br />i. Contains different conditions or is otherwise more stringent than any effluent <br />limitation in the permit; or <br />ii. Controls any pollutant not limited in the permit. <br /> <br />b. The permit, as modified or reissued under this paragraph, shall also contain any other <br />requirements of the Clean Water Act when applicable. <br /> <br />13. Records Retention <br /> <br />a. Permittees shall retain, and make available for inspection and copying, all records of <br />information obtained pursuant to any monitoring activities required by this permit, <br />any additional records of information obtained pursuant to monitoring activities <br />undertaken by the permittee independent of such requirements, and documentation <br />associated with Best Management Practices established under Section 17-8 of the <br />South Bend Municipal Code. Records shall include the date, exact place, method, and <br />time of sampling, and the name of the person(s) taking the samples; the dates analyses <br />were performed; who performed the analyses; the analytical techniques or methods <br />used; any information used to demonstrate that the analysis was performed in <br />accordance with methods approved in 40 CFR Part 136; and the results of such <br />analyses. These records shall remain available for a period of at least three (3) years. <br />This period shall be automatically extended for the duration of any litigation <br />concerning the permittee or the City, or where the permittee has been specifically <br />notified of a longer retention period by the Director. <br /> <br />14. Federal and State Pretreatment Requirements <br /> <br />a. Compliance with this wastewater discharge permit does not relieve the permittee of <br />responsibility for compliance with all applicable Federal and State Pretreatment
