REGULAR MEETING NOVEMBER 14 2012 84 <br />ACCEPT AND APPROVE APPLICATION FOR RETIREMENT — JEFFREY WALTERS <br />In a letter to the Board, Chief Charles Hurley submitted the Application and Declaration for <br />Retirement for Division Chief Jeffrey Walters, effective October 28, 2012. In his letter, Chief Hurley <br />noted that Chief Walters is retiring in good standing after serving the Department for the last twenty - <br />five (25) years, one (1) month and twelve (12) days. Chief Hurley joined the Board in thanking him <br />for his many years of distinguished service to the South Bend Police Department and the citizens of <br />South Bend. Upon a motion made by Mr. Miller, seconded by Mr. Collins and carried, the <br />application for retirement was accepted and approved effective October 28, 2012. <br />APPROVE REQUEST FOR PAID EXTENDED MEDICAL LEAVE — ROSA ALVAREZ <br />In a letter to the Board, Chief Hurley, Police Department, stated that Patrolman Rosa Alvarez <br />requests the Board grant her a paid, extended medical leave of approximately forty -two (42) calendar <br />days from November 10, 2012 to December 21, 2012. Upon a motion made by Mr. Miller, seconded <br />by Mr. Collins and carried, the paid, extended medical leave was approved effective November 10, <br />2012 to December 21, 2012. <br />FILING OF MONTHLY STATISTICAL ANALYSIS REPORT — OCTOBER 2012 <br />Mr. Cottrell indicated that unless there were questions or objections by members of the Board, the <br />statistical analysis report for the month of October, 2012, as submitted by the Police Department, <br />would be accepted for filing. The report indicated <br />the specialized training attended; the names of the officers who attended; and the costs involved. <br />There being no questions concerning this report, the Quarterly Report for Specialized Training as <br />submitted was accepted and filed. <br />FIRE DEPARTMENT <br />ACCEPT AND FILE POSITION STATEMENT — SHAWN KUMINECZ GRIEVANCE <br />President Cottrell stated the Board is in receipt of a Statement of position of the South Bend Fire <br />Department from Fire Chief Stephen Cox regarding the grievance filed by Firefighter Shawn <br />Kuminecz. President Cottrell noted he understands there is also a position statement from Mr. <br />Kumineez's attorney that the Board has not yet reviewed. Therefore, Mr. Cottrell stated he is <br />requesting the Board table the approval of this statement until both letters could be reviewed. Mr. <br />Meteiver noted the Board can accept for filing the Chief's letter, and table the grievance at this time. <br />Therefore, Mr. Taylor made a motion the Board accept and file the Chiefs letter and table the <br />grievance. Mr. Collins seconded the motion, which carried. <br />RATIFY AMENDMENT TO MEMORANDUM OF UNDERSTANDING — UNIVERSITY OF <br />NO RE DAME <br />President Cottrell stated that on October 9, 2012, Chief Stephen Cox entered into an agreement with <br />the University of Notre Dame du Lac on behalf of the Fire Department for the purpose of amending <br />the previously approved MOU to allow for the Notre Dame Fire Department to add service as the <br />primary responder for fire prevention and emergency response services to the former St. Joseph high <br />School. He noted the present agreement includes Innovation Park and the Indiana University School <br />
