PUBLIC AGENDA SESSION APRIL 24, 2008 ADOPT RESOLUTION NO. 23 -2008 — A RESOLUTION APPROVING FORM OF DEED AND AUTHORIZING CLERK TO EXECUTE DEED (NAPOLEON STREET — LOT 32) Upon a motion made by Mr. Inks, seconded by Mr. Gift and carried, the following Resolution was adopted by the Board of Public Works: RESOLUTION NO. 23 -2008 A RESOLUTION APPROVING FORM OF DEED AND AUTHORIZING CLERK TO EXECUTE DEED (NAPOLEON STREET — LOT 32) WHEREAS, the Board of Public Works ol!"the City of South Bernd, Indiana (the "Board ") previously adopted Resolution No. 13 -2008, entitled a "RE SOLUTION RELATED TO ACQUISITION OF PROPERTY IN THE CITY OF SOUTH BEND, INDIANA (NAPOLEON STREET — LOT 32) on March 24, 2008, which declared the Board's desire to acquire the real properly located in St. Joseph County, Indiana, and described as follows: Lot Numbered Thirty -two (32) as shown on the recorded Plat of Hartman and Woodorth's Addition to the City of South Bernd, (the "ROW Property "); and WHEREAS, after due notice and public hearing, the Board adopted Resolution No. 1.7- 2008, entitled "A RESOLUTION CONFIRMING ACQUISITION OF PROPERTY 11\ THE CITY OF SOUTH BEND, INDIANA (NAPOLEON STREET — LOT 32)" on April 14, 2003, which confirmed the Board's desire to acquire the ROW Property and which was conclusive as to all persons; and WHEREAS, the Staff prepared and filed with the Board a report, listing two appraisals prepared, setting forth the fair market value of said ROW property; and WHERE AS, the Board considered the staff s report and the appraisals, and them. adopted Resolution No. 22 -2008, entitled "A RESOLUTION SETTING ACQUISITION PRICE FOR PROPERTY LOCATED IN THE CITY OF SOUTH BEND, INDIANA (NAPOLEON STREET — LOT 32)" on April 28, 2008, which set the amount of dainages at Fourteen Thousand Dollars ($14,000.00) payable to the owner of the ROW Property; and WHEREAS, in order to transfer title to the Row Property from the owner to the City, the Clerk of the Board should. execute and record a deed conveying all right, title and interest in the ROW Property to the City of South Bend, for the use and benefit of its Board of Public Worms. NOW, THEREFORE, BE IT RESOLVED, by the City of South Bend, Indiana, Board of Public Works, as follows: Lot Numbered Thirty -two (32) as shown on the recorded Plat of Hartman and Woodworth's Addition to the City of South Bernd, Tax Ivey Number 18-5097-344-4); and C. Provide that such conveyance is subject only to all non - delinquent taxes and assessments; and d. Be executed by the Clerk under her official seal; and e. Be in the form attached hereto and incorporated herein. 1 That this Resolution shall be in full force and effect upon its adoption.
