PUBLIC AGENDA SESSION APRIL 24, 2008 _5 <br />Lot Numbered Thirty-two (32) as shown on the recorded Plat of Hartman and <br />Woodworth's Addition to the City of South Bend, <br />(the "ROW Property") and which was conclusive as to all persons; and <br />WHEREAS, Resolution No. 17-2008, further directed the Staff to prepare a list of <br />all the property owners or holders of the ROW Property, and of interests in it, sought to be <br />acquired or to be injuriously affected by the resolution and to file such list with the Board for <br />furt"ller consideration as to the damages, if any, and the benefits, if any, resulting to such owners <br />or holders by reason of the appropriation as by law provided.; and <br />WHEREAS, the Staff prepared and filed with the Board a report as directed by <br />Resolution No. 17-2008, setting forth the fair market value of said ROW property as Fourteen <br />Thousand Dollars ($14,000.00) in the form attached hereto; and <br />WHEREAS, the Board has considered the staff's report and the appraisals, and finds that <br />the amount of damages of Fourteen Thousand Dollars ($14,000.00) should be paid to the owner <br />C, <br />of the ROW Property on account of the Board's acquisition of the ROW Property; and <br />NOW, THERE-FORE, BE IT RESOLVED, by the City of South Bend, Indiana, Board of <br />Public Works, as follows: <br />L The Board now awards damages to the owner of the ROW Property in the amount <br />of Fourteen Thousand Dollars ($14,000.00) on account of the Board's acquisition of the ROW <br />Property situated in St. Joseph County, State of Indiana, to-wit: <br />Lot Numbered Thirty-two (32) as shown on the recorded Plat of Hartman and <br />Woodworth's Addition to the City of South Bend, <br />Tax Key Number 18-5097-3444. <br />3.
