Any alteration, enlargement, or <br /> extension of a nonconforming building, structure, or use which would <br /> constitute an increase in the value of the property, excluding the <br /> value of the land, by more than forty (40) percent shall be in <br /> conformance with the provisions of this chapter. <br /> ( 3) A nonconforming building, structure or use located within <br /> the "F" Floodplain, "F-1" Floodway, or "F-2" Floodway Fringe District <br /> which is damaged by fire, flood, explosion, act of God or the public <br /> enemy, may be restored to its original dimensions and conditions, <br /> provided the damage does not reduce the value of the building, <br /> excluding the value of the land, by more than forty ( 40) percent of its <br /> predamage value.
