South Bend Redevelopment Commission <br />Regular Meeting - December 17, 1999 <br />August 1998, the Commission accepted a <br />proposal from Mr. Richard Boocher of <br />A. C. Rich & Company, Inc. for the <br />purchase of Parcel 9A in the Studebaker <br />Corridor portion of the Sample -Ewing <br />Development Area. This lot is located at <br />the northeast corner of Garst and <br />Lafayette Streets. Since that time, we have <br />been working with Mr. Boocher and his <br />representatives to reach agreement on a <br />Contract for Sale of Land for this <br />property. To date we have been unable to <br />do so. In the fall of 1998 Mr. Boocher <br />asked if he could use this lot for parking <br />until he completed the purchase of the <br />property and the Commission approved <br />this request to use the lot for parking. <br />Since that time, Mr. Boocher has used it <br />for storage of materials in addition to <br />parking of vehicles. The property has <br />been partially fenced and has a great <br />amount of materials piled on it. This is in <br />violation of the permission that the <br />Commission gave for parking and has <br />resulted in an extremely messy and <br />unsightly lot. Because we do not seem to <br />be able to get a signed Contract from Mr. <br />Boocher, the staff recommends that the <br />Commission revoke its acceptance of the <br />proposal from A. C. Rich & Company, Inc. <br />and notify Mr. Boocher to cease using the <br />property for parking and to immediately <br />remove all materials from the property. It <br />is the staff's recommendation that Mr. <br />Boocher remove everything from the lot no <br />later than December 31, 1999. <br />Upon a motion by Mr. Donoho, seconded COMMISSION REVOKED ITS ACCEPTANCE OF THE <br />PROPOSAL FROM A.C. RICH & COMPANY, INC. AND <br />IL -20- <br />
