OLD BUSINESS (CONT.) <br />a. continued.... <br />The City agrees not to lease any more <br />delicatessen or "sub" type shop spaces in <br />Leighton Plaza's retail space; (2) <br />Quizno's can assign the Agreement to <br />another Quizno's franchisee, subject to <br />the franchisee meeting certain conditions <br />and the Commission receiving written <br />notice of the Assignment and written <br />proof and assurance from Quizno's that <br />these conditions have been met. <br />Quizno's also wants an absolute limit on <br />how much all other costs (beyond rent) <br />would be in the first year. The <br />Commission agrees that the total of all <br />rental payments and any and all other <br />sums, excluding the monthly rent, will <br />not exceed $1.50 per sf during the first <br />calendar year of the Lease. <br />Mrs. Aladean DeRose, City Attorney, <br />drafted the Lease and worked with the <br />tenant on revisions. Also, Brad <br />Toothaker, CB Richard Ellis /Sturges <br />Bradley, reviewed the Lease and <br />Addendum as well. Dave Risner of Da- <br />Lin, Inc. signed the Lease and <br />Addendum. The staff recommends <br />accepting the Lease and Addendum from <br />Da -Lin, Inc. (d.b.a.
